Zaman zaman yaflanan dalgalanmalara ra¤men yakalanan olumlu seyir, flirketimizin de geliflmesindeki ana etken oldu. Bireysel Emeklilik Sistemi (BES) 2006 y›l›n› ekonomideki geliflmelerin paralelinde ve öngörülerimiz do¤rultusunda tamamlad›. Hem sektörümüzdeki, hem de flirketimizdeki büyüme devam etti. Geçti¤imiz y›l›n sonunda, sektörün önemli oyuncular› aras›nda olmay› sürdüren flirketimizin kat›l›mc› say›s› 173 bin 620'ye, sözleflme say›s› 184 bin 958 adede, fon büyüklü¤ü de 480 milyon 628 bin YTL'ye ulaflt›. fiirketimizdekinin yan› s›ra Bireysel Emeklilik Sistemi'nde ulafl›lan büyüklükler de sistemin sa¤l›kl› gelifliminin göstergesi oldu. Emeklilik Gözetim Merkezi verilerine göre sistemin 3. y›l›n› geride b›rakt›¤› 2006 sonunda toplam kat›l›mc› say›s› 1 milyon 73 bin 650'ye, sözleflme say›s› 1 milyon 141 bin 428 adede ulaflt›. Sektörün fon büyüklü¤ü de 2 milyar 820 milyon 105 bin YTL oldu. fiirketimizin pazar pay›, sözleflme say›s›nda yüzde 16,38 ve fon büyüklü¤ünde yüzde 17,04 olarak gerçekleflti. Yaflam sigortac›l›¤› alan›nda ise 2005 y›l›nda sektör 4'üncüsü olan flirketimiz, birikimli hayat sigortalar›ndan BES'e aktar›mlar›n da ard›ndan 2006 y›l› sonunda yeni sigortal›larla birlikte 385 bin 924 yaflam sigortal›s›na sahip oldu. 2006 y›l›nda bu branfltaki prim üretimi 111 milyon 845 bin YTL olarak gerçekleflti ve yüzde 8,07 pazar pay›yla sektör 4'üncülü¤ümüz devam etti. fiirketimiz önümüzdeki y›l da Bireysel Emeklilik Sistemi'nin yan› s›ra yaflam sigortac›l›¤›nda yeni gelifltirdi¤i risk ürünleri ve ipote¤e dayal› konut finansman› sisteminin (mortgage) etkisiyle varl›¤›n› büyüterek sürdürecektir. Koç Finansal Hizmetler flemsiyesine girerek önemli bir de¤iflim yaflad›¤›m›z 2005 y›l›n›n ard›ndan, 2006 bu kez sektörümüzde önemli de¤iflimlere tan›k oldu¤umuz bir y›l oldu. Geçti¤imiz y›l içinde bankac›l›ktaki geliflmeye paralel olarak sektörümüz tamam› yabanc› kökenli yeni oyuncularla birlikte güçlenirken, biz de bugüne kadar sürdürdü¤ümüz öncü ve lider rolümüzü Koç Finansal Hizmetler'in sahipli¤inde pekifltirerek devam ettirdik. fiirketimiz Koç Toplulu¤u ile UniCredit'in oluflturdu¤u çok uluslu yap›n›n sa¤lad›¤› avantajlar›, önümüzdeki dönemde de rekabetteki yerini güçlendirmek için de¤erlendirecektir. Önümüzdeki dönemde, yenilikçili¤in ve sürdürülebilir büyümenin yan› s›ra müflteri memnuniyeti ve sözleflme süreklili¤inde de sektörde öncü bir rol üstlenecektir. Kemal KAYA Yönetim Kurulu Baflkan› 6 Yönetim Kurulu Baflkan›’n›n Mesaj› Message of Chairman The steps taken in the last five years to ensure permanent economic stability have also proved effective in 2006. The positive progress achieved despite occasional fluctuations was the key factor for the development of our company as well. The Private Pension System (PPS) closed 2006 parallel to economic developments and in line with our projections. Both our sector and our company continued growing. The number of participants of our company, which continues to count among the key players of the sector, reached 173,620, the number of contracts reached 184,958 and the fund size reached YTL 480,628,000 at the end of last year. The figures attained in the Private Pension System in addition to those attained in our company were also an indicator of the healthy development of the system. According to data provided by the Pension Monitoring Center at the end of 2006, which also marked the end of the system's 3rd year, the total number of users reached 1,073,650 and the number of contracts reached 1,141,428. The fund size of the sector amounted to YTL 2,820,105,000. The market share of our company realised as 16.38% of the number of contracts and 17.04% of the size of funds. In the field of life insurance, our company, which had ranked 4th in the sector in 2005, reached 385,924 policy holders at the end of 2006, following the transfer of saving life insurances to the PPS, including those who were newly insured. The premium generation in this area accrued as YTL 111,845,000 and we retained the 4th rank with a market share of 8.07% in the sector in 2006. Our company will be maintaining its presence by growing further with the new risk products it has developed in the life insurance area in addition to the Private Pension System and with the effect of the mortgage system in the coming year as well. After 2005, when we had experienced significant changes by being included under the roof of Koç Financial Services, 2006 was a year when we witnessed important developments in our sector. In the year we left behind, in line with the developments in banking, our sector also strengthened by welcoming new players, all of foreign origin, and we maintained our long-held role of innovativeness and leadership by consolidating it under the ownership of Koç Financial Services. Our company will also make use of the advantages brought by the multinational structure formed by the Koç Group and UniCredit in order to reinforce its position within the competition in the forthcoming period. We will assume a leading role in the sector with regard to customer satisfaction and contractual continuity as well as innovativeness and sustainable growth in the period ahead. Kemal KAYA Chairman of the Board of Directors Message of Chairman 7 Genel Müdür’ün Mesaj› Faaliyette bulundu¤umuz Bireysel Emeklilik Sistemi'ndeki geliflme 2006 y›l›nda da devam etti. Sistem 3. y›l›n› tamamlarken ulafl›lan 1 milyon kifliyi aflk›n kat›l›mc› say›s›, kifliye ve aileye yönelik di¤er bir finans ürünü olan özel sa¤l›k sigortalar› ile karfl›laflt›r›ld›¤›nda baflar›l›d›r. Ülkemizde 20 y›ld›r sat›fl› sürdürülen özel sa¤l›k sigortas›nda poliçe sahibi say›s› poliçe kapsam›ndaki efl ve çocuklar da dahil 974 bindir. Durumu fonlar aç›s›ndan da de¤erlendirdi¤imizde büyümenin kartopu etkisiyle devam etti¤ini gözlemekteyiz. 2006 y›l› sonunda 2,3 milyar YTL fon büyüklü¤ü hedeflenirken, daha A¤ustos ay›nda bu hedefin afl›ld›¤› görülmektedir. Geliflmeler çerçevesinde biz de flirket olarak sistemdeki önemli varl›¤›m›z› sürdürdük. Geçti¤imiz y›l flirketimizde müflteri memnuniyeti, çal›flanlar›m›z›n e¤itimi ve toplumsal sorumluluk alan›nda da çeflitli çal›flmalar gerçeklefltirdik. Öncelikle büyüyen sözleflme say›m›z ve müflterilerle iliflkimizin uzun süreli oldu¤u göz önüne al›nd›¤›nda müflteri yönetiminin önemi bir kez daha ortaya ç›kmaktad›r. Bu amaçla müflteri yönetimimizin kalitesini, uluslararas› ba¤›ms›z bir kurulufl olan BSI taraf›ndan yaz›lan CMSAS 86:2000'i Türkiye'de alan ilk flirket olarak belgelendirdik. Bo¤aziçi Üniversitesi Yaflamboyu E¤itim Merkezi (BÜYEM) iflbirli¤i ve Watson Wyatt'›n deste¤iyle kurulan sektörümüzün ilk Bireysel Emeklilik ve Sigorta Akademisi'nde sat›fl ekiplerinin yan› s›ra idari kadrolar›m›z da e¤itim almaya bafllad›. Bu, çal›flanlar›m›z›n kariyer ve kiflisel geliflimine verdi¤imiz önemin kan›tlar›ndan biridir. “Toplumsal duyarl›l›¤› yüksek” flirket olma çabam›z›n en belirgin göstergesi sosyal sorumluluk projelerimizdir. TEMA ortakl›¤› ve Harran Üniversitesi Ziraat Fakültesi'nin deste¤iyle 2003'te bafllatt›¤›m›z Safran projesini Aral›k 2006'da tamamlad›k. Projenin yaratt›¤› ilgi çerçevesinde bugün Safranbolu'da bir destek program› ile fianl›urfa'da iki yeni proje bafllat›ld›. Bir baflka çal›flmam›z ise fiubat 2006'da faaliyete bafllayan Yafll›l›k Araflt›rmalar› Merkezi (65+)'d›r. Ülkemizin yak›n gelece¤inde karfl›m›za ç›kacak yafll› nüfus konusuna bugünden dikkat çekmeyi amaçlayan merkezin çal›flmalar›n› önümüzdeki y›l kamuoyuyla paylaflaca¤›z. Son olarak Uluslararas› Sualt› Arkeolojisi Enstitüsü (INA) ortakl›¤› ve Türkiye Sualt› Arkeolojisi Vakf›'n›n (TINA) katk›lar›yla 550 Türk denizcisinin ve onlara yard›m eden Japon bal›kç›lar›n an›s›n› canland›rmak amac›yla önemli bir projeye imza att›k. “Ertu¤rul F›rkateyni: Japonya'da bir Türk gemisi” isimli projemiz çerçevesinde, 1890 y›l›nda Japonya'da sulara gömülen Ertu¤rul F›rkateyni'nin kal›nt›lar›n›n tespiti ve su üstünü ç›kar›lmas›, daha da önemlisi tarih bilincinin genç kuflaklara aktar›lmas› amaçlan›yor. 8 Genel Müdür’ün Mesaj› Yap› Kredi Emeklilik olarak vizyonumuz, sektörüne geliflim ve de¤iflimle öncülük eden, yaratt›¤› fonlarla ülke ekonomisine katk›da bulunan, Türk finans piyasas›n›n önde gelen oyuncular›ndan biri olmakt›r. Bir di¤er hedefimiz ise hizmetlerimizi daha da ileri götürmek ve müflterilerimize emekliliklerine uzanan yolda hem rehberlik etmek, hem de karfl›laflabilecekleri risklere karfl› güvence sa¤lamakt›r. Amac›m›z 2007'de de toplumumuzun gelece¤e dair planlar›n› güvence alt›na almak ve finansal aç›dan kendi ayaklar› üzerinde durabilecek bir nesil yaratmakt›r. Sayg›lar›mla, Doç. Dr. S. Giray VEL‹O⁄LU Genel Müdür Genel Müdür’ün Mesaj› 9 Message of General Manager The development in the Private Pension System, within which we operate also continued in 2006. More than one million participants were achieved as the system completed its third year; this is a successful growth when compared with private health insurance which is another financial product intended for individuals and families. The number of policy owners of private health insurance, which has been sold in our country for twenty years, is 974,000 including spouses and children covered by the insurance. As we assess the situation in terms of funds, we observe that the growth has been achieved with a snowball effect. While a fund size of YTL 2.3 billion had been aimed for at the end of 2006, this target had already been exceeded in August. As a company we also maintained our remarkable presence in the system. Last year we also realized various activities about customer satisfaction, employee training and in the field of social responsibility. First of all, the importance of customer management was highlighted once again considering the increasing number of our contracts and our long-term customer relations. In order to achieve this aim, we certified our customer management quality by being the first company in Turkey to obtain CMSAS 86:2000 issued by the BSI, an international independent organisation. Our administrative staff members as well as our sales teams started to be trained in the first Private Pension and Insurance Academy of the sector, founded with the cooperation of the Lifelong Learning Centre of Bo¤aziçi University (BUYEM) and the support of Watson Wyatt. This is a solid proof of the importance we attach to the careers and self-development of our employees. Our social responsibility project is the key indicator of our efforts to become a “company with a high level of social sensibility.” We completed the Saffron Project, which we had initiated in 2003 with the partnership of TEMA (the Turkish Foundation for the Fight Against Erosion) and the support of the Faculty of Agriculture of Harran University in December 2006. Thanks to the interest the project aroused, a support programme was started in Safranbolu and two new projects are underway in fianl›urfa today. Another activity of ours is the Old Age Research Center (65+), which was commissioned in February 2006. Next year we will publicise the activities of the center aimed at drawing attention to the elderly population issue awaiting our country in the near future. Lastly, we implemented a significant project for reviving the memory of 550 Turkish mariners and the Japanese fishermen who helped them, with the partnership of the International Institute of Nautical Archaeology (INA) and the contribution of the Turkish Institute of Nautical Archaeology (TINA). The project “Ertu¤rul Frigate: A Turkish Ship in Japan” aims to locate and recover the wreckage of the Ertugrul Frigate, which sank in Japanese waters in 1890, and more importantly to provide younger generations with historical awareness. 10 Message of General Manager As Yap› Kredi Emeklilik, our vision is to be one of the leading players in the Turkish finance market, which pioneers the sector with its development and evolution and contributes to the Turkish economy by the funds it creates. Another objective of our company is to spread our services further and guide our customers on the road to retirement and provide them with assurance against the risks that they might be confronted with. Giray VEL‹O⁄LU, Ph.D. General Manager Message of General Manager 11 fiirketimizdeki ve Sektörümüzdeki Geliflmeler Ülkemizde gönüllülük esas›na dayanan ve sosyal güvenlik sisteminin tamamlay›c›s› olarak kurulan Bireysel Emeklilik Sistemi (BES) 27 Ekim 2003'te ilk emeklilik planlar›n›n sat›fl›yla bafllad› ve bu süre içerisinde oldukça h›zl› bir geliflim gösterdi. Sadece 3 y›l gibi k›sa sürede kat›l›mc› say›s› 1 milyon kifliyi aflarak 31 Aral›k 2006 tarihi itibariyle 1 milyon 73 bin 650'ye ulaflt›.(1) Fonlardaki (2) büyüme de kartopu etkisiyle devam etti ve y›lsonu itibariyle fon tutar› 2.820.105.000 YTL oldu. Bu 3 y›ll›k süreç içinde flirketimiz de sektördeki öncü rolünü yeni kilometre tafllar›n› geride b›rakarak sürdürdü. Sistemde 50 bin sözleflme say›s›na, ard›ndan sistemin ikinci y›l›nda 100 bin sözleflme say›s›na ve 100 milyon YTL fon büyüklü¤üne ulaflan ilk flirket oldu. En yüksek sözleflme say›s› ve fon büyüklü¤üne ulaflan ilk flirket olma özelli¤ini 2006'da da devam ettirdi. Son olarak Haziran (3) (4) 2006'da 150 bin sözleflme say›s› ve 300 milyon YTL fon büyüklü¤ünü aflan ilk emeklilik flirketi oldu. 2006 y›l› sonunda da flirketimizdeki kat›l›mc› say›s› 173 bin 620, sözleflme say›s› 184 bin 958 ve fon büyüklü¤ü de 480.628.351 YTL olarak gerçekleflti. fiirket olarak Bireysel Emeklilik Sistemi'nde bugüne kadar oldu¤u gibi önümüzdeki dönemde de hem sözleflme say›s›nda, hem de fon büyüklü¤ünde önemli varl›¤›m›z› sürdürece¤imize inan›yoruz. Kat›l›mc›lar›n Fon Tercihleri Bireysel Emeklilik Sistemi'ndeki kat›l›mc›lar›n fon tercihleri incelendi¤inde bugün itibariyle BES'teki fon büyüklü¤ünün yaklafl›k yüzde 65'inin devlet iç borçlanma senetlerine yat›r›m yapan kamu borçlanma araçlar› ve likit-kamu emeklilik yat›r›m fonlar›ndan olufltu¤u görülmektedir. Devlet iç borçlanma senetlerine yat›r›m yapan esnek ve dengeli fonlar ile Eurobondlar'a yat›r›m yapan kamu d›fl borçlanma araçlar› fonlar› da eklendi¤inde bu oran yüzde 80-85'e ulaflmaktad›r. Bu sonuçlar çerçevesinde sistem kat›l›mc›lar›n›n bugüne kadar olan yat›r›m tercihlerinin sabit getirili menkul k›ymetler yönünde oldu¤u söylenebilir. Di¤er ülkelere bak›ld›¤›nda, yat›r›m tercihlerinde farkl›l›klar görülmektedir. ‹ngiltere ve ABD gibi ülkelerde tahvil-bono yan›nda hisse senedi yat›r›mlar›n›n da tercih edildi¤i görülürken, örne¤in Japonya'da tahvil-bono a¤›rl›kl› bir yat›r›m tercihi oldu¤u gözlenmektedir. Ayr›ca, 2006 y›l› yurtd›fl› hisse senedi piyasalar› aç›s›ndan iyi geçmesine ra¤men, uzun dönemde hisse senetlerinde yaflanan performans düflüklükleri, di¤er ülkelerde, özellikle faiz garantisi bulunan emeklilik sistemlerinde tahvil bono yat›r›mlar›n› artt›rm›flt›r. Aktar›mla, Bireysel Emeklilik Sistemi'nden önce emeklilik birikimi yapmak amac›yla birikimli hayat sigortas› ürünü alan kiflilere, herhangi bir hak kayb›na u¤ramadan BES'e geçme imkan› tan›nmaktayd›. Bu süre dolmadan önce aktar›mdan yararlanabilecek müflteri grubuna aktar›m tavsiye tablolar› arac›l›¤›yla detayl› bilgilendirme yap›larak en do¤ru karar› alabilmeleri konusunda yard›mc› olunmaya çal›fl›ld›. Emeklilik Gözetim Merkezi'nin 31 Aral›k 2006 tarihli verilerine göre birikimli hayat sigortalar›ndan BES'e aktar›m tutar› 597 milyon 108 bin 355 YTL'dir. Aktar›m›n tamamlanmas› bireysel emeklilik pazar›nda önemli bir de¤iflikli¤e neden olmam›flt›r. Do¤al olarak geçmiflteki baflar›l› çal›flmalar› nedeniyle önemli bir hayat sigortas› portföyüne sahip olan flirketimiz, yüksek miktarda aktar›m gerçeklefltirmifltir. EGM'nin 9 Ekim 2006 tarihli verileri dikkate al›nd›¤›nda flirketimizde sözleflmeleri yürürlükte olan 32 bin 383 birikimli hayat sigortas› kat›l›mc›s› ile 142 milyon 258 bin 75 YTL tutar›nda aktar›m gerçekleflmifltir. Hayat Sigortalar›nda Son Durum Hayat sigortalar›nda sektördeki toplam müflteri say›s› 7 milyon 429 bin 487, flirketimizdeki hayat sigortal› say›s› ise 385 bin 924'tür. fiirketimizde 2006 y›l›nda hayat sigortas› prim üretimi 111.844.869 YTL olmufltur. Sektördeki prim üretimi ise 1.385.926.144 YTL'dir. Hayat sigortas›nda flirketimizin 2006 y›l› matematik karfl›l›klar› 518.593.437 YTL'dir. Aktar›mla birlikte küçülen hayat sigortas› portföyü yeni gelifltirilen risk ürünleriyle büyütülmektedir. Pazara Yabanc› ‹lgisi Bankac›l›k alan›nda yaflanan de¤iflimin bir benzeri sigorta sektörü ve Bireysel Emeklilik Sistemi'nde yaflanmaktad›r. 2006 y›l›nda sat›n alma ve birleflme yoluyla pek çok yabanc› sermayeli kurulufl Türk finans sektörüne kat›lm›flt›r. Bankac›l›k ve sigorta sektöründeki bu de¤iflimden emeklilik flirketleri de pay›n› alm›flt›r. Ancak hem hayat sigortac›l›¤›, hem de bireysel emeklilik branfl›nda faaliyet gösteren bir flirket olarak hayat branfl›n›n da katk›lar›yla önümüzdeki y›l kâra geçmeyi beklemekteyiz. 14 fiirketimizdeki ve Sektörümüzdeki Geliflmeler Developments in Our Company and within the Sector The Private Pension System (PPS), based on a voluntary system and launched as a complement to the social security system in our country, started with the sales of the first pension plans on October 27, 2003 and since then developed quite rapidly. Within the relatively short period of three years, the number of participants exceeded one million and reached 1,073,650 by December (1) 31, 2006. The increase in funds continued to have a snowball effect and the amount of funds (2) accrued to YTL 2,820,105,000 by the year end. Our company maintained its leading role in the sector by leaving new milestones behind during that three-year period. We were the first company to reach 50,000 contracts in the system and 100,000 contracts and a fund size of YTL 100,000,000 in the second year. In 2006, we also retained the title of having the largest number of contracts and the largest fund size. Finally, our company was the first pension company to exceed 150,000 contracts (3)and a fund size of YTL (4) 300,000,000.00 in June 2006. The number of our participants reached 173,620, the number of contracts reached 184,958 and the fund size accrued to YTL 480,628,351 at the end of 2006. We believe that our company will maintain its remarkable presence in terms of both number of contracts and fund size in the Private Pension System in the forthcoming period, the same way as it has up to now. Fund choices of participants When the fund choices of participants in the Private Pension System are observed, it is noted that about 65% of the fund size in the PPS consists of government debt instruments invested in government securities and liquid government debt instruments pension funds today. The ratio reaches 80-85% as managed and balanced funds investing in government securities and public foreign borrowing instrument funds investing in Eurobonds are included. In the light of these results, it could be said that the investment choices of system participants have so far been inclined towards securities with fixed yield rates. Investment choices vary as far as other countries are concerned. It is seen that stock investments are also preferred in addition to bills and bonds in countries such as the United Kingdom and the United States of America, whereas i.e. in Japan the investment choice is mainly based on bills and bonds. On the other hand, in other countries, the poor performance of stocks in the long term boosted investment in bills and bonds in pension systems particularly in those with interest guarantees, despite the fact that 2006 was favourable in terms of foreign stock markets. (1) www.egm.org.tr (2) www.spk.gov.tr (3) 150,908 ( as of 19 June 2006) (4) YTL 308,027,268 ( as of 19 June 2006) Developments In Our Company and Within The Sector 15 Transfers from Saving Life Insurance Policies Were Completed The saving life insurance policies that became effective before October 27, 2003 and were not cancelled had had the privilege of being transferred to the Private Pension System by October 7, 2003. The transfer intended to provide those who had purchased saving policies prior to the introduction of the Private Pension System to have pension accumulations with the opportunity of transferring the accumulations to the PPS without being deprived of any rights. The customer group who were entitled to benefit from the transfer before the expiration of the period was informed about the transfer in detail with transfer recommendation charts and was offered help in making the right decision. The amount of transfer of accumulations in life insurances to the PPS is YTL 597,108,355 according to the Pension Monitoring Centre (EGM) data of December 31, 2006. The completion of the transfers did not cause a significant change in the private pension market. Our company, which had a remarkable life insurance portfolio, thanks to its successful activities carried out in the past, naturally executed a high volume of transfer. According to the EGM data of December 9, 2006, our company executed a transfer of YTL 142,258,075 with 32,383 policy holders whose contracts were in force. The Final Situation In Life Insurance The total number of customers in the life insurance sector is 7,487,000 and the number of persons with life insurance in our company is 385,924. The premium generation in life insurance was YTL 111,844,869 in 2006. As for the premium generation in the sector, it amounts to YTL 1,385,926,144. The life insurance figures of our company stand at YTL 518,593,437 for 2006. The life insurance portfolio that shrank because of transfers is growing with recently developed risk products. The Interest Of Foreigners In The Market A change similar to that experienced in the field of banking has also been experienced in the insurance sector and the Private Pension System. Many foreign capital companies entered the Turkish finance sector through acquisitions and mergers in 2006. Pension companies were also affected from such changes in the banking and insurance sector. Today, foreign capital holds shares in many pension companies, which was not the case when this activity started on October 27, 2003. This indicates that the market potential is primarily monitored and demanded by the foreign capital. While the private pension sector gains strength with new players, the long-held innovative and leader role of Yap› Kredi Emeklilik is consolidated further under the ownership of Koç Financial Services formed by the Koç Group-UniCredit. 16 Developments In Our Company and Within The Sector Persistency Of Contracts In The System The success achieved by the Private Pension System in three years is the primary indicator of our people's trust in the system. However, it should not be ignored that it is a new and developing sector. During our works regarding the system, the company emphasized strongly the following points; accurate description of the system and the products, providing the exact products suitable for the needs and expectations of people and creating realistic expectations. The essential point is thinking on a long term basis, arranging accumulations in the long term and considering the long term yield of the fund while choosing mutual pension funds rather than short term benefits. Our company values persistency to the extent that that it reviewed all its processes and conducts activities for participants to encourage the persistency of contracts with a committee formed last year consisting of company executives. Our Customer Management Quality Is Certified When the increasing number of contracts and the long-term customer relations are considered, customer management once again deserves the top agenda in the sector. To this end, we had planned to be accredited by an international independent organisation while reviewing the customer services policy and company targets in the last period. Within this framework, Yap› Kredi Emeklilik became the first Turkish company to obtain CMSAS86:2000, which is a certificate similar to ISO 9000 in customer services, issued by the BSI, an international independent organisation. This application provides guidance for organisations about how to implement an effective customer management system in ensuring customer satisfaction, performance improvement and complaints handling in the best way possible. Profit Expectations For The Next Year It is not expected for a company functioning in the Private Pension System to start making profit before between five to eight years because of the start-up costs and promotional expenses. Our company also stated in the Feasibility Report submitted to the Undersecretariat of Treasury at the stage of conversion into a pension company that it would start making profit at the end of the fourth year because of its infrastructural expenses and ownership costs just as it would be the case anywhere in the world and prepared the feasibility report within this scope. The feasibility study conducted in 2002 had presupposed that the Private Pension System would commence in 2002. However, due to the long preparations of the companies and the meticulous approach for formulating the legislation, which stands as one of the key factors for the success of the system, the system was initiated at the end of 2003 (especially for the existing life portfolio). Furthermore, despite the fact that group pension plans grew a bit slower than private pension plans and Yap› Kredi's ownership structure has changed, our company completed a successful period of three years thanks to a fruitful preparation period and the strength of Yap› Kredi brand. Our company ended up with a loss in 2006 as had already been foreseen. Nevertheless, as a company functioning in the areas of both life insurance and private pensions, next year we expect to make a profit with the contribution of life insurance business. Developments In Our Company and Within The Sector 17 Sosyal Güvenlik, Mortgage ve Beklentiler Ülkemizde Ocak 2007’de uygulamaya girmesi beklenen Sosyal Güvenlik Reformu birçok hükümetin ortak çabas›yla sonuçlanm›flt›r ve mevcut hükümet bu reformu yasalaflt›rarak konuya önem verdi¤ini göstermifltir. Ancak Meclis'teki yasalaflman›n ard›ndan Cumhurbaflkan› ve Anayasa Mahkemesi kapsam›nda yaflanan süreç sonucunda kanunun uygulanmas› ertelenmifltir. Yasan›n seçimin ard›ndan yeni kurulacak hükümet taraf›ndan uygulamaya sokulmas› beklenmektedir. 2007 y›l› bafl›nda yasalaflmas› beklenen Mortgage Kanunu'nun ise sektörümüzün geliflimine katk› sa¤layaca¤› aç›kt›r. Yasalaflmas›yla birlikte kredi hayat sigortalar›na olumlu etkisi beklenmektedir. Yasa De¤ifliklikleri Gündemde Bireysel Emeklilik Sistemi dünya deneyimlerinden ve Türkiye'de çok iyi çal›flan fon altyap›s›ndan yararlan›larak kurulmufltur. Teknolojinin olanaklar›ndan faydalanan, son derece sa¤lam ve fleffaf bir sistemdir. Bu altyap›yla kat›l›mc›lar›n çal›flma yaflamlar› boyunca do¤ru planlama ve do¤ru strateji ile vergi avantajlar›ndan yararlanarak tasarruf etmeleri, bu tasarruflar›n› izlemeleri ve yönetmeleri sa¤lanmaktad›r. Bunlar› mümkün k›lan BES'in, mevcutta zaten çok iyi olan yasal altyap›s›n› daha da iyi duruma getirecek yeni kanun de¤ifliklikleri Meclis gündeminde bulunmaktad›r. Bireysel Emeklilik Sistemi'yle ilgili gündemdeki maddeler flöyle s›ralanabilir: • EGM'nin mevzuatsal konumuna iliflkin düzenleme yap›lmas› • Grup emeklilik planlar›nda hak etme kriteri (vesting) esaslar›na iliflkin düzenleme yap›lmas› • Bireysel emeklilik hesaplar›n›n ayl›k ödeme tutar›n›n asgari ücrete kadar olan k›sm›n›n haczedilmemesi/rehnedilmemesi. • ‹flveren hesaplar›, vak›f ve sand›klardaki hesaplar›n BES'e aktar›labilmesi. Önümüzdeki aylarda uygulamay› kolaylaflt›ran bu düzenlemelerin gerçekleflmesiyle sektörün geliflimin h›zlanarak artmas›n› bekliyoruz. 18 Sosyal Güvenlik, Mortgage ve Beklentiler Social Security, Mortgage and Expectations Social Security Reform, which is expected to commence in our country in January 2007, was finalised by the joint efforts of many governments, and the current government proved the importance it attaches to the reform by legalising it. However, following the adoption of the reform in the Parliament the implementation of the law was postponed as a result of a process in the scope of the President of the Republic and the Constitutional Court. It is expected that the law will be put into effect by the new government which takes office after the elections. It is also clear that the Mortgage Law, which is expected to be adopted in early 2007, will contribute to the development of our sector. It is estimated that the law will exert a positive influence on credit based life insurances following its adoption. Law Amendments On The Agenda The Private Pension System was built by benefiting from global experiences and the fund infrastructure that has worked very well in Turkey. It is a very robust and transparent system which utilizes technological means. The infrastructure ensures that participants save by following the right plans and strategies while benefiting from tax advantages and keep track of and manage their savings throughout their professional lives. New amendments that will further improve the legal infrastructure of the PPS are on the agenda of the Parliament. Items on the agenda relating to the Private Pension System are as follows: • Making arrangements for the legislative status of the EGM (Pension Monitoring Centre) • Making arrangements for the principles of vesting in group pension plans • Not sequestrating / mortgaging the portion of the monthly payment amount up to the amount of the minimum wage of private pension accounts. • Transferring employer accounts and trust and fund accounts transferable to the PPS. We expect that the sector's growth will accelerate following the materialization of these arrangements, which will facilitate the implementation. Social Security, Mortgage and Expectations 19 Sosyal Sorumluluk Safran Tar›m› Yay›l›yor TEMA ortakl›¤› ve Harran Üniversitesi Ziraat Fakültesi'nin deste¤iyle Ekim 2003'te bafllat›lan “Safran Bitkisinin Gen Kaynaklar›n›n Korunmas› ve Ülkemizde Tar›m›n›n Yeniden Yayg›nlaflt›r›lmas›” projesi 3. y›l›n sonunda, 4. ekim döneminin pefli s›ra Aral›k 2006'da tamamland›. Safran projesi bafllat›l›rken en önemli amaçlardan biri proje isminde de belirtildi¤i gibi unutulmakta olan gen kayna¤›n›n korunmas› ve tar›m›n›n yeniden yayg›nlaflt›r›lmas›yd›. Proje süresinin sonunda, özellikle bas›nda yer alan haberlerin ard›ndan safran tar›m› birçok kesimin ilgisini çekti. Bugün projenin gerçekleflti¤i Harran Ovas›, Kuruyer köyü, Çütlük mezras›n›n yan› s›ra fianl›urfa'da biri Avrupa Birli¤i destekli iki ekim projesi için çal›flmalar yürütülmektedir. Safran projesinin gerçeklefltirilmesinde büyük eme¤i olan Harran Üniversitesi'nden Doç. Dr. Tahir Polat, fianl›urfa'daki bu projelere dan›flmanl›k vermektedir. 19. yüzy›la kadar Anadolu'nun birçok yöresinin yan› s›ra fianl›urfa civar›nda da yap›lan safran ekimi, son y›llarda sadece Safranbolu'da çok dar bir alanda sürdürülüyordu. Safran projesinin bir di¤er önemli katk›s› da Safran'dan ad›n› alan Safranbolu ve Karabük'te de yaratt›¤› yank›d›r. Karabük ‹l Tar›m ve Safranbolu ‹lçe Tar›m Müdürlükleri taraf›ndan haz›rlanan bir projeyle bölgede safran tar›m›n›n yeniden canland›r›lmas› hedeflenmektedir. Merkezin amac›, henüz nüfus dengeleri de¤iflmeden Türkiye'de yafll› ve yafllanan nüfusun hayat›n içine girmesi ve yaflam kalitesinin artmas› için mevcut yaflam koflullar›n›n sosyal boyutunu ortaya koymakt›r. Dünya deneyimlerinden faydalanarak bu koflullar›n iyilefltirmesi için yard›m ve rehberlik amac›yla araflt›rma yapmak/yap›lmas›n› sa¤lamak ve konuyu kamuoyunun gündemine tafl›makt›r. Ertu¤rul F›rkateyni: Japonya’da Bir Türk Gemisi Geçti¤imiz y›l ayr›ca Uluslararas› Sualt› Arkeoloji Enstitüsü (INA) ortakl›¤› ve Türkiye Sualt› Arkeolojisi Vakf›'n›n (TINA) katk›lar›yla 550 Türk denizcisinin ve onlara yard›m eden Japon bal›kç›lar›n an›s›n› canland›rmak amac›yla önemli bir proje bafllat›ld›. 3 y›l sürmesi öngörülen proje çerçevesinde 1890 y›l›nda Japonya'da sulara gömülen Ertu¤rul F›rkateyni'nin kal›nt›lar›n›n tespiti ve su üstünü ç›kar›lmas›, daha da önemlisi flehit olan 550 denizcinin an›s›n›n hem Türkiye'de, hem de Japonya'da canland›r›lmas› amaçlanmaktad›r. Bu kapsamda ilk araflt›rma çal›flmalar› ve dal›fllar Türkiye'den ve dünyadan sualt› arkeolojisinin en önemli isimlerinden oluflan bir ekip taraf›ndan Ocak 2007'de Japonya'n›n Kushimoto kentinde gerçeklefltirilecek. (www.ertugrul.jp) Sosyal Sorumluluk 21 Social Responsibility Saffron Agriculture Is Expanding The project “Preservation of Gene Sources and Reviving Agriculture of Saffron Plant in Our Country”, initiated by the partnership of TEMA (Turkish Foundation for Fight Against Erosion) and the support of the Faculty of Agriculture of Harran University in October 2003, was finalised in December 2006 at the end of its 3rd year and following the 4th cultivation period. One of the key purposes of the Saffron Project was to preserve the gene sources of the saffron plant that had been on the verge of being completely forgotten and once again to disseminate saffron agriculture as also mentioned in the title of the project. At the end of the term of the project, saffron agriculture attracted the attention of many groups, particularly following news in the media. Today, activities for two cultivation projects, one of them sponsored by the European Union, are conducted at the Çütlük site, Kuruyer Village, on the Harran Plain and in fianl›urfa. Assoc. Prof. Dr. Tahir Polat of Harran University, who contributed enormously to the realization of the Saffron Project, acts as a consultant in the projects implemented in fianl›urfa. Saffron, which had been cultivated in many regions in Anatolia, including fianl›urfa until the 19th century, had been cultivated on a very limited scale in Safranbolu in recent years. Another significant contribution of the saffron project is the reverberation created by the project in Safranbolu, which derives its name from the saffron plant, and in Karabük. It is aimed at reviving saffron agriculture in the region by means of a project prepared by the Directorate of Agriculture of Karabük Province and Directorate of Agriculture of Safranbolu District. The farmers who shall cultivate saffron in the scope of the project have been provided with extensive support. Old Age Research Center (65+) In February 2006, the Old Age Research Center (65+) was founded to bring up the subject of existing status of old people in Turkey, in particular the social dimensions of the issue, to identify the problems that might be arise in the future and to assist with taking necessary precautions. The Old Age Research Center (65+) intends to put forward the social aspects of the issues related to old age on Turkey's agenda, to create a platform about the old and the ageing population that has not yet occupied a privileged position on Turkey's agenda and to exert efforts for the realisation of these aims. The purpose of the center is to determine the social realities of the existing conditions for the involvement of the old and the ageing population in everyday life and the improvement their life qualities before the population balances shift. The center also aims to conduct research and to ensure that research is conducted for assistance and guidance in improving those conditions by utilising global experience and to bring the issue to the attention of the public opinion. The Old Age Research Center (65+) conducts its research and activities under four main headings: 22 Social Responsibility • The effects of societal change and the dynamics of modern life such as the core family, working women and urban life on old people. • Handling the elderly separately with advanced segment conception in all sectors and in the public and generating the data to feed that conception. Gathering data to guide service and product providers to this extent. • Altering the perception of old age in society and by old people themselves (emphasizing positive examples instead of examples like disabled, irritable, independent, wise, lonely, suffering etc.) • Determining the conditions required for spending the old age happily. The center has surveyed and examined the research conducted on social life and active ageing in Turkey and in the world and compiled literature in line with these principles. GfK Turkey, a research company, was commissioned to conduct qualitative and quantitative research on the perception of old age and the problems of old people in Turkey, to conduct. The center also prepared www.yaslilikrehberi.org.tr, a portal comprising research and subjects intended for old people, which can be accessed by everyone and which everyone can become a member of via the Internet. Ertu¤rul Frigate: A Turkish Ship In Japan In addition, an important project was initiated to revive the memory of 550 Turkish mariners and the Japanese fishermen who helped them with the partnership of the International Institute of Nautical Archaeology (INA) and contributions of the Turkish Institute of Nautical Archaeology (TINA) last year. In the extent of the project which will last three years, it is aimed that the wreckage of the Ertu¤rul Frigate, which sank in Japanese waters in 1890, will be located and recovered, and, more importantly, the memory of the 550 mariners who were martyred will be revived both in Turkey and in Japan. A team comprised of the most celebrated figures in the field of nautical archaeology in Turkey and the world will perform the first explorations and dives in Kushimoto, Japan in January 2007. (www.ertugrul.jp) Social Responsibility 23 Bireysel Emeklilik ve Sigorta Akademisi Bo¤aziçi Üniversitesi Yaflamboyu E¤itim Merkezi (BÜYEM) iflbirli¤i ve dünyan›n önde gelen dan›flmanl›k flirketlerinden Watson Wyatt'›n deste¤iyle kurulan Bireysel Emeklilik ve Sigorta Akademisi'nde ilk ders zilinin ard›ndan 1,5 y›l geride b›rak›ld›. Akademi'de bu süre zarf›nda e¤itimlerin daha akademik, tan›ml› ve sistematik bir yap›da verilmesi için gerekli altyap› kuruldu ve e¤itimlerin bu çerçevede gerçekleflmesi sa¤land›. E¤itimlerde, çal›flanlar›n görüflleri al›narak geliflmeye aç›k alanlar belirlendi, bu alanlar› iyilefltirmek ve güçlü alanlar› belirleyip daha da güçlendirmek yönündeki çal›flmalar ise sürdürülüyor. Bireysel Emeklilik ve Sigorta Akademisi'nde 2006 y›l› içinde sat›fl ekibi ve idari personel olmak üzere tüm çal›flanlar›n ald›¤› e¤itimler göz önünde bulunduruldu¤unda kifli bafl› ortalama al›nan e¤itim süresi 91 saati buldu. Akademi dahilinde 2006 y›l› içinde toplam 3 bin 121 saat e¤itim süresinde, tüm çal›flanlar için toplam 75.989 adam x saat e¤itim verildi. Ayr›ca; • Sat›fl ve idari personel için unvan gruplar› baz›nda ö¤retim programlar› haz›rland›. • E¤itimler, görev tan›mlar›ndan yola ç›k›larak ve baz› unvanlar için e¤itim ihtiyaç analizi çal›flmalar› yap›larak, içerik ve kullan›lan yöntemler aç›s›ndan çal›flanlar›n kiflisel ve mesleki geliflimlerini art›racak flekilde planland›. • Her unvan için ayr› ayr› haz›rlanan e¤itim plan›n›n duyurusu yap›ld›. • Ders kodlama sistemi ve kredi sistemi tasarland›. • Baz› unvanlar için projeler haz›rland› ve bu çal›flmalar hayata geçirildi. 24 Bireysel Emeklilik ve Sigorta Akademisi Private Pension and Insurance Academy The Private Pension and Insurance Academy, founded by the cooperation of the Lifelong Learning Centre of Bo¤azici University (BUYEM) and the support of Watson Wyatt, one of the leading consultancy companies in the world has been operating for 1.5 years. During this period, the infrastructure required to provide training in a more academic, defined and systematic structure was built and training programs took place within this framework. During the training programs, employees expressed their opinions and consequently the areas for development were determined. There is still work being done for the improvement of these areas and also for determining the strengths and for reinforcing them even further. The training programs provided for all employees including the sales teams and the executive personnel in the Private Pension and Insurance Academy in 2006 corresponds to an average of 91 hours of training per employee. In 2006, a total of 75,989 persons x hour training were provided for all employees during 3,121 hours of training by the academy. Furthermore; • Some teaching programmes on a title group basis were arranged for sales team members and the executive personnel. • The training programmes were planned by starting with task descriptions and training need analysis for some titles in a way to improve the personal and professional development of employees in terms of content and the methods applied. • Training schedules arranged separately for each title were announced. • Course coding system and credit system were designed. • Projects were devised and implemented for some titles. Yaz›lan Primler Prim geliri, y›l içinde tanzim edilmifl poliçelerden iptaller ve vergiler düflüldükten sonra tahakkuk esas›yla kaydedilen gelirdir. Vadesi bir y›l› aflan birikimli hayat sigortas› poliçeleri için prim geliri, ödeme vadesi o y›l tahakkuk eden gelirlerden oluflmaktad›r. Vadesi bir y›ldan az olan poliçeler için prim gelirleri söz konusu dönemin tüm primini kapsamaktad›r. Yap› Kredi Emeklilik A.fi. 31 Aral›k 2006 ve 2005 ‹tibariyle Ayr›nt›l› Bilanço Dipnotlar› 45 fiirket politikas›, hayat branfl›yla ilgili primlerin tahsilat›n›n gerçeklefltirilememesi durumunda ihtar prosesi çal›flt›r›ld›ktan sonra cevap gelmemesi halinde öngörülen süre içinde poliçe iptalinin yap›lmas›n› ve bu iptalin fiirket kay›tlar›na yans›t›lmas›n› öngörmüfltür. 11.3. Al›nan ve Ödenen Komisyonlar Ç›kar›lan sigorta poliçelerinin sat›fllar› ile ilgili komisyon giderleri ve reasürörlerden al›nan komisyon gelirleri poliçenin ç›kar›ld›¤› dönem içinde faaliyet sonuçlar›na yans›t›lmaktad›r. 11.4. ‹krazlar ‹krazlar, fiirket'in tasdikli hayat sigortas› tarifelerine iliflkin olarak teknik esaslarda belirtilen süre boyunca (Hayat Sigortas› Genel fiartlar›na göre bu süre minimum 3 y›ld›r) prim ödemesi yapan hayat sigortal›lar›yla ilgili tarifenin ifltira tablosundaki tutarlar›n belirli bir oran› dahilinde hayat sigorta poliçesinin iadesi karfl›l›¤›nda verdikleri ödünç para tutarlar›n› ifade etmektedir. 11.5. Hayat Matematik ve Kâr Pay› Karfl›l›klar› Hayat branfl› karfl›l›¤›, aktüeryal matematik karfl›l›klar› (sigortal›ya sabit bir gelirin taahhüt edilmesi) ve kâr pay› karfl›l›klar›ndan oluflmakta olup, fiirket'in hayat sigortas› branfl›nda sigortal›lara yükümlülüklerini göstermektedir. Hayat matematik karfl›l›klar›, hayat branfl› ile ifltigal eden sigorta flirketlerinin gelecekte vadesi geldi¤i zaman ödemeyi garanti ettikleri tazminatlar için ay›rd›klar› karfl›l›kt›r. Sigorta Murakabe Kanunu'na göre fiirket'in hayat branfl› taraf›ndan akdedilen hayat sigorta sözleflmeleri uyar›nca tahsil edilen safi primlerden idare ve tahsil masraflar›, ölüm (mortalite) risk primi ve komisyonlar›n›n indirilmesi sonucu kalan tutar hayat matematik karfl›l›¤› olarak ayr›lmaktad›r. Matematik karfl›l›klar›n›n onay› yurtd›fl›nda haz›rlanan ölüm istatistikleri dikkate al›narak aktüerlerce Türk Sigorta flirketleri için geçerli olan cari tablolar kullan›larak yap›lmaktad›r. Bu karfl›l›klar›n yat›r›mlara dönüflmesi sonucu elde edilen gelirler için kâr pay› karfl›l›¤› ayr›lmaktad›r. Kâr pay› karfl›l›klar› y›l içinde hayat branfl›nda tahsil edilen primler karfl›l›¤›nda hesaplanmaktad›r. 11.6. Hayat Branfl› Fon Geliri Hayat branfl›ndaki fon geliri, dönem içinde yap›lan yat›r›mlardan elde edilen gelirin Sigorta Murakabe Kurulu'nun onaylad›¤› verimlilik oran›yla ayarlanmas› sonucu hesaplanmakta ve hayat branfl› di¤er gelirleri içerisinde gösterilmektedir. 11.7. Muallak Hasar ve Tazminat Karfl›l›¤› Dönem sonu itibariyle fiirket'e bildirimi yap›lm›fl ve inceleme safhas›nda olup bedeli ödenmemifl hasar dosyalar›yla ilgili tüm yükümlülükler için ayr›lan karfl›l›kt›r. Muallak hasarlar karfl›l›¤›, eksper raporlar›na veya sigortal› ve eksperin ilk de¤erlendirmelerine uygun olarak belirlenmektedir. Muallak hasarlar›n reasürörlere ait k›sm› teknik gelirler alt›nda muallak hasarda reasürör pay› hesab›na yans›t›lmaktad›r. 46 Yap› Kredi Emeklilik A.fi. 31 Aral›k 2006 ve 2005 ‹tibariyle Ayr›nt›l› Bilanço Dipnotlar› 27 Ocak 2004 tarihli ve 25359 say›l› Resmi Gazete'de yay›mlanarak yürürlü¤e giren “Sigorta ve Reasürans fiirketlerinin Kurulufl ve Çal›flma Esaslar› Yönetmeli¤inde De¤ifliklik Yap›lmas›na Dair Yönetmelik” çerçevesinde sigorta flirketleri, 2004 y›l›ndan bafllamak üzere her hesap döneminde, branfllar itibariyle muallak hasar ve tazminat karfl›l›¤› ile ilgili olarak yeterlilik oranlar›n› hesaplamak ve bu oranlara ba¤l› olarak muallak hasar ve tazminat karfl›l›¤› yeterlilik fark› ay›rmakla yükümlüdürler. Bu çerçevede muallak hasar ve tazminat karfl›l›¤› yeterlilik oran›n›n cari hesap dönemi hariç olmak üzere, 2004 y›l› için son üç y›ll›k ortalamas›n›n yüzde 90'›n alt›nda olmas› halinde, sigorta flirketlerince cari hesap döneminde, bu oran ile yüzde 90 oran› aras›ndaki fark tutar› kadar muallak hasar ve tazminat karfl›l›¤› yeterlilik fark› ayr›l›r. Hazine Müsteflarl›¤›'n›n 18 Ocak 2005 tarih ve 3821 say›l› yaz›s›na ek olarak verilen Muallak Hasar ve Tazminat Karfl›l›¤› Yeterlilik Tablosu'nda hayat branfl› yer almamas›ndan dolay› fiirket, 31 Aral›k 2006 tarihi itibariyle hayat branfl›nda muallak hasar ve tazminat karfl›l›¤› yeterlilik oran›n› hesaplamam›fl, ferdi kaza branfl›nda ise 31 Aral›k 2006 tarihi itibariyle son befl y›l›n ortalama muallak hasar karfl›l›¤› yeterlilik oran› yüzde 90'›n üstünde oldu¤undan fiirket ilave olarak muallak hasar karfl›l›¤› yeterlilik fark› ay›rmam›flt›r. Sigorta flirketlerinin 2004 y›l› sonundan bafllamak üzere, bilanço tarihi itibariyle gerçekleflmifl ancak rapor edilmemifl hasar ve tazminat bedelleri için ilave muallak hasar karfl›l›¤› ay›rmas› gerekmektedir. Bu çerçevede fiirket, 31 Aral›k 2006 tarihi itibariyle, gerçekleflmifl ancak rapor edilmemifl hasar ve tazminat bedelleri ile ilgili olarak 700.884 YTL ( 31 Aral›k 2005: 611.816 YTL) tutar›nda net muallak hasar karfl›l›¤› ay›rm›flt›r. 31 Aral›k 2006 tarihi itibariyle muallak hasarlar hayat branfl›nda dava aflamas›nda olan muallak hasarlarla ilgili olarak oluflabilecek faiz giderlerini de içermektedir. 11.8. Sigortac›l›k Faaliyetlerinden Alacaklar Karfl›l›¤› Hazine Müsteflarl›¤›'nca 26 Aral›k 1994 tarihli ve 22153 no'lu Resmi Gazete'de yay›mlanarak 1 Ocak 1995 tarihinden itibaren yürürlü¤e giren Sigorta ve Reasürans fiirketleri'nin Kurulufl ve Çal›flma Esaslar› Yönetmeli¤i'nin 27. maddesi uyar›nca sigorta flirketleri, sigorta acenteleri ve sigortal›lar nezdindeki prim alacaklar›ndan muaccel olup da, iki ay içinde tahsil edilemeyen k›sm›n›n tamam› kadar prim alacak karfl›l›¤› ay›rmakla yükümlüdürler. fiirket 31 Aral›k 2006 tarihi itibariyle prim alacak karfl›l›¤›n› 45.566 YTL olarak hesaplam›fl ve kay›tlar›na yans›tm›flt›r (31 Aral›k 2005: 56.232 YTL olarak hesaplanm›fl ancak söz konusu tutar›n önemsellik arz etmedi¤i göz önünde bulundurularak kay›tlara yans›t›lmam›flt›r). 11.9. Bireysel Emeklilik ‹fllemleri 31 Aral›k 2006 tarihi itibariyle fiirket'in onbir adet kurulu yat›r›m fonu bulunmaktad›r. Bireysel Emeklilik Sistemi alacaklar›, emeklilik yat›r›m fonlar›na yap›lan sermaye avanslar›, fonlardan fon iflletim kesintisi alacaklar› ve saklay›c› flirketten alacaklardan oluflmaktad›r. fiirket, Yap› Kredi Emeklilik A.fi. 31 Aral›k 2006 ve 2005 ‹tibariyle Ayr›nt›l› Bilanço Dipnotlar› 47 fonlardan fon iflletim kesintisi alacaklar› hesab› alt›nda, fonlar›n yönetiminden kaynaklanan ve ayn› gün içerisinde tahsil edilemeyen fon iflletim gideri kesintisi alacaklar›n› takip etmektedir. fiirket taraf›ndan kurulan emeklilik yat›r›m fonlar›na tahsis edilen avanslar, emeklilik yat›r›m fonlar›na yap›lan sermaye avanslar› hesab›nda takip edilmektedir. 31 Aral›k 2006 tarihi itibariyle fiirket'in emeklilik yat›r›m fonlar› üzerinde sermaye avans› bulunmamaktad›r. Kat›l›mc›lar ad›na saklay›c› flirketten fon baz›nda alacaklar, saklay›c› flirketten alacaklar kalemi alt›nda s›n›fland›r›lmaktad›r. Bu tutar ayn› zamanda Bireysel Emeklilik Sistemi borçlar› kalemi alt›nda sat›fl› gerçekleflen fonlar için kat›l›mc›lara borçlar olarak gösterilmektedir. Bireysel Emeklilik Sistemi borçlar›, önceki paragrafta aç›klanan kat›l›mc›lara borçlar hesab›na ek olarak kat›l›mc›lar geçici hesab› ve bireysel emeklilik arac›lar›na borçlardan oluflmaktad›r. Kat›l›mc›lar geçici hesab›, kat›l›mc›lar ad›na henüz yat›r›ma yönlendirilmemifl paralar ile kat›l›mc›lar›n sistemden ayr›lmas› veya birikimlerini baflka bir flirkete aktarmas› durumunda, kat›l›mc›ya ait fon paylar›n›n sat›fl› sonras›, söz konusu sat›fl iflleminden elde edilen bedelden varsa girifl aidat› borçlar› ve benzeri kesintilerin yap›larak kat›l›mc›lara ödenecek veya di¤er bir flirkete aktar›m yap›lacak tutar›n izlendi¤i hesap kalemidir. Fonlar›n yönetim ve temsili ile fonlara tahsis edilen donan›m, personel ve muhasebe hizmetleri karfl›l›¤› olan fon yönetim gideri kesintisi, fiirket hesaplar›nda gelir olarak kaydedilmekte ve fiirket ile Yönetici aras›nda, anlaflma dahilindeki oranlar çerçevesinde paylaflt›r›lmaktad›r. Söz konusu ücretlerin tamam› fiirket'in teknik gelirleri içerisinde fon iflletim gider kesintisi olarak, yöneticiye ait olan k›sm› ise fiirket'in teknik giderleri içerisinde fon iflletim karfl›l›¤›nda ödenen tutar olarak gösterilmektedir. Kat›l›mc›lar›n bireysel emeklilik hesab›na yap›lan katk› paylar› üzerinden azami yüzde sekiz oran›n› aflmamak kayd›yla al›nan gider kesintileri, yönetim gideri kesintisi hesab› alt›nda takip edilmektedir. Girifl aidat› gelirleri hesab›nda, kat›l›mc›lar›n Bireysel Emeklilik Sistemi’ne ilk kez kat›lmas› s›ras›nda veya yeni bir bireysel emeklilik hesab› açt›rmas› durumunda kat›l›mc›lardan emeklilik sözleflmesinin imzaland›¤› tarihte geçerli olan asgari ücretin ayl›k tutar›n› aflmamak kayd›yla tahakkuk eden tutar izlenmektedir. fiirket bireysel planlar›nda girifl aidat› tutar›n›n yar›s›n› ilk sözleflme y›l› içerisinde katk› pay› ödeme vadelerinde tahsil edip, di¤er yar›s›n› 10 y›l süre ile kat›l›mc›n›n Bireysel Emeklilik Sistemi’nden ayr›ld›¤› veya baflka bir flirkete aktar›m talebinde bulundu¤u tarihe kadar ertelemektedir. YTL sözleflmeler için girifl aidat›n›n ertelenen k›sm› enflasyona endekslenmektedir. Bununla birlikte fiirket bafllang›çta ald›¤› girifl aidat› tutar›na istinaden, yeni sözleflmelere 10 y›l süre ile girifl aidat›n›n ertelenen tutar›na eflit bir devaml›l›k ödülünü, kat›l›mc›n›n bireysel emeklilik hesab›n› 10 y›l süre ile kesintisiz olarak fiirket'te bulundurmas› durumunda emeklilik hesab›na aktarmak üzere tan›mlam›flt›r. Emeklilik yat›r›m fonlar›na iliflkin fon portföyünün oluflturuldu¤u tarih ile fon paylar›n›n tamamen sat›ld›¤› tarih aras›nda oluflan portföy de¤er de¤iflimleri sermaye avans tahsisi faiz gelirleri olarak gelir tablosunda kaydedilmektedir. 48 Yap› Kredi Emeklilik A.fi. 31 Aral›k 2006 ve 2005 ‹tibariyle Ayr›nt›l› Bilanço Dipnotlar› Fonlar›n içtüzüklerinin 4. maddesi uyar›nca, fon paylar›n›n sat›fla sunulmas›n› takip eden alt› ay sonunda fiirket aktifindeki paylar›n tamam› fonlara iade edilmemifl ise belirtilen sürenin sonunda bu paylar›n tamam› fonlara iade edilerek bu paylara karfl›l›k gelen tutarlar›n fonlar taraf›ndan fiirket'e ödenmesi gerekmektedir. 11.10. Menkul K›ymetler 30 Aral›k 2004 tarih ve 25686 say›l› Resmi Gazete'de yay›mlanan Sigortac›l›k Hesap Plan› ve ‹zahnamesi Hakk›nda Tebli¤'e istinaden 1 Ocak 2005 tarihinden itibaren yürürlükte olan Sigortac›l›k Hesap Plan› uyar›nca fiirket finansal varl›klar›n›, sat›lmaya haz›r finansal varl›klar ve al›m sat›m amaçl› finansal varl›klar olmak üzere 2 ayr› grup içerisinde s›n›fland›rmaktad›r. Bu çerçevede, al›m sat›m amaçl› menkul k›ymetlerin de¤erleme sonucu ortaya ç›kan de¤er art›fl ve azal›fllar› kâr/zarar tablosuna yans›t›lmaktad›r. Sat›lmaya haz›r olarak s›n›fland›r›lan menkul k›ymetler rayiç de¤erleri ile de¤erlenmektedir. Sözkonusu k›ymetlerin tahakkuk eden faiz gelirleri kâr/zarar tablosuna yans›t›lmakta, rayiç de¤erlerindeki de¤iflikliklerden kaynaklanan gerçekleflmemifl kazanç ve kay›plar›n fiirket'e ait olan k›sm›n› ifade eden 810.002 YTL (31 Aral›k 2005: 1.146.744 YTL) ise özkaynaklar içindeki “Finansal varl›klar›n de¤erlenmesi” hesab› alt›nda izlenmektedir. fiirket'e ait olmayan de¤erleme farklar›n›n %95'ine tekabül eden 13.773.261 YTL (31 Aral›k 2005: 21.788.130 YTL), sigortac›l›k teknik karfl›l›klar› alt›nda muhasebelefltirilmektedir (27 no'lu bilanço dipnotu). 11.11. Finansal Varl›klar fiirket'in 31 Aral›k 2004 tarihi itibariyle yeniden düzenlenen mali tablolar›nda gösterilen ba¤l› menkul k›ymetler, ifltirakler ve ba¤l› ortakl›klar, enflasyona göre düzeltilmifl maliyet bedellerinden enflasyon nedeniyle oluflmas›na izin verilen yeniden de¤erleme de¤er art›fl fonu gibi fonlar›n sermayeye eklenmesi nedeniyle elde edilen tutarlar ve kur farklar› dahil finansman giderleri indirildikten sonra kalan tutarlar dikkate al›narak Sermaye Piyasas›nda Muhasebe Standartlar› Hakk›nda Tebli¤'de (Seri XI, No:25) yer alan, 'Yüksek Enflasyon Dönemlerinde Mali Tablolar›n Düzeltilmesi' ile ilgili k›s›mdaki hükümlere göre yeniden düzenlenmifl de¤erleri ile gösterilmifltir. Finansal varl›klar›n rayiç de¤erlerinin, enflasyona göre düzeltilmifl maliyet de¤erlerinden düflük oldu¤u durumlarda söz konusu farklar için de¤er düflüfl karfl›l›¤› ayr›lm›flt›r. 11.12. Maddi ve Maddi Olmayan Varl›klar fiirket'in 31 Aral›k 2004 tarihi itibariyle yeniden düzenlenen mali tablolar›nda amortismana tabi maddi varl›klar ile maddi olmayan varl›klar, ilgili varl›klar›n elde etme maliyetinin Sermaye Piyasas›nda Muhasebe Standartlar› Hakk›nda Tebli¤'de (Seri XI, No:25) yer alan, 'Yüksek Enflasyon Dönemlerinde Mali Tablolar›n Düzeltilmesi' ile ilgili k›s›mdaki hükümlere göre sat›n alma senesine ait uygun düzeltme katsay›s› ile çevrilmek suretiyle yeniden düzenlenmifl de¤erleri üzerinden gösterilmifltir. Yap› Kredi Emeklilik A.fi. 31 Aral›k 2006 ve 2005 ‹tibariyle Ayr›nt›l› Bilanço Dipnotlar› 49 ‹lgili amortisman, tükenme ve itfa paylar› enflasyona göre düzeltilmifl yeni de¤erleri üzerinden geçmifle flamil olacak flekilde do¤rusal amortisman yöntemi kullan›larak hesaplanm›flt›r. K›dem Tazminat› Karfl›l›¤› Yürürlükte olan ‹fl Kanunu, flirkette bir hizmet y›l›n› doldurmufl olan her personele sebepsiz olarak iflten ç›karma veya emeklili¤e hak kazanma, 25 hizmet y›l›n› doldurma (kad›nlarda 20 y›l), askere ça¤r›lma veya ölüm hallerinde k›dem tazminat› ödemeyi öngörür. Ödenecek tazminat her hizmet y›l› için bir ayl›k maafl tutar›d›r ve beher hizmet y›l› için 1.857,44 YTL (31 Aral›k 2005: 1.727,15 YTL) ile s›n›rland›r›lm›flt›r. fiirket'in 31 Aral›k 2006 tarihi itibariyle hesaplanan toplam k›dem tazminat› yükümlülü¤ü 5.313.256 YTL (31 Aral›k 2005: 4.886.803 YTL)'dir. 11.15. Yabanc› Para Birimi ile Olan ‹fllemlerin Yeni Türk Liras›'na Çevrilmesi Dövize dayal› ifllemler ifllem tarihindeki geçerli kurlar esas al›narak muhasebelefltirilmifl olup, bilanço tarihleri itibariyle yabanc› para cinsinden kasa, banka, menkul de¤er ve borç bakiyeleri, bilanço tarihlerindeki TCMB döviz al›fl kurlar› ile de¤erlenmifltir. Prim tahakkuklar› tarife kurlar› üzerinden ve genelde TCMB efektif sat›fl kurlar› ile de¤erlenmifltir. Vergi Karfl›l›¤› Kurumlar vergisi oran› 2006 y›l› için %20'dir (2005: %30). Kurumlar vergisi oran› kurumlar›n ticari kazanc›na vergi yasalar› gere¤ince indirimi kabul edilmeyen giderlerin ilave edilmesi, vergi yasalar›nda yer alan istisna (ifltirak kazançlar› istisnas›, yat›r›m indirimi istisnas› vb.) ve indirimlerin (ar-ge indirimi gibi) indirilmesi sonucu bulunacak vergi matrah›na uygulan›r. Türkiye'deki bir iflyeri ya da daimi temsilcisi arac›l›¤› ile gelir elde eden dar mükellef kurumlar ile Türkiye'de yerleflik kurumlara ödenen kâr paylar›ndan (temettüler) stopaj yap›lmaz. Notes To The Balance Sheet At 31 December 2006 And 2005 (Amounts expressed in New Turkish Lira (YTL) unless otherwise indicated) 1) Nature of operations: The main operation of the Company is to act in private pension fund system and, as a result of this activity, to prepare private pension contracts, to fulfill all transactions defined in the laws and regulations related with pension funds, and also to issue all kinds of group and individual life and personal accident policies in Turkey and foreign countries and to perform all related reinsurance transactions. Effective from 1 January the Company ceased to generate premiums in health branch and Yap› Kredi Sigorta A.fi., the main shareholder of the Company started to produce health premiums. The title of the Company, which was Yap› Kredi Yaflam Sigorta A.fi. has changed as Yap› Kredi Emeklilik A.fi. on 30 December 2002. The article of association of the Company has been changed by approval (no 81316) dated 20 December 2002 of Undersecreteriat of Treasury and initial authorization (no 10919) dated 20 December 2002 of Ministry of Trade and Industry. Preparation of financial statements The communiqué of the Undersecreteriat of the Treasury regarding the Insurance Chart of Accounts and Prospects, published in the Official Gazette (No:25686) dated 30 December 2004, (Insurance Accounting System Communiqué No.1) has come into force at 1 January 2005 and effective from 1 January 2005, the Company has prepared its financial statement in accordance with the Insurance Chart of Accounts indicated in the above mentioned communiqué. It was announced with the article of the Undersecreteriat of the Treasury (No:19387, dated 4 April 2005), insurance companies are required to restate their financial statements as of 31 December 2004 in accordance with “Financial Reporting in Hyperinflationary Economies” included in the regulations of the CMB Capital Markets Board (''CMB'') Communiqué XI No.25 (which came into force as published in the Official Gazette No:25290 dated 15 January 2003). In line with the decree of the CMB dated 17 March 2005, the Undersecreteriat of the Treasury also announced that insurance companies are not required to apply inflation accounting effective from 1 January 2005. Based on the above mentioned article of the Undersecreteriat of the Treasury, the Company has restated its financial statements as of 31 December 2004 in accordance with the regulations regarding “Financial Reporting in Hyperinflationary Economies” as a one time application and has therefore not continued to apply inflation accounting effective from 1 January 2005. Written premiums Premium income represents premiums on policies written during the year, net of cancellations and taxes. Premium income regarding the saving life insurance policies with maturities over one year, are composed of the income accrued within the related year. Premium income from policies that have maturities within one year are composed of all premium income of that respective year. According to the policy of the Company, in the case of uncollection of life premiums, warning letter is sent to policyholder. If no answer is received within the determined time, the cancellation process is initiated and this cancellation is adjusted in the records. 11.3. Commissions paid and received Commissions paid to intermediaries related to sales of insurance policies and commissions received from reinsurers are accounted for in the operational results in the period in which the insurance policies are issued. 11.4. Policy loans Policy loans are expressed as loans given to policyholders, who make premium payment during a period defined in life insurance tariffs, convenient with technical basis. According to General Terms of Life Insurance, this period could be minimum three years. The amount is a defined percent of the amount in the participation table. 11.5. Life mathematical and profit share reserves Life technical reserves consist of life mathematical reserves (net savings premium) and life profit share reserves and represent the Company's total liability to the policyholders in the life branch. Life mathematical reserves are accounted for obligations that mature in the future by insurance companies operating in the life branch. In accordance with Insurance Supervisory Law, the remaining amount of life branch premiums that are collected in accordance with life insurance agreements, after deduction of expense charges, mortality risk premium and commissions are accounted for as life mathematical reserves. These reserves are calculated based on approved technical tariffs and accounted for in the financial statements. Life profit share is provided for in respect of the financial income generated from investing in these reserves. Life profit share is accounted for income obtained from the utilization of these reserves in funds. Life mathematical reserve is calculated on the basis of life premiums that are due in the year, and profit share is provided on life branch premiums collected in the year. 76 Yap› Kredi Emeklilik A.fi. Life branch fund income Fund income of life branch is calculated based on the productivity rate, approved by Insurance Supervisory Law, on the income of the current period investments and is rolled in other income in life branch. 11.7. Claim provisions A full provision has been made for the estimated ultimate cost of settling claims incurred as of the balance sheet date, less amounts already paid in respect of these claims. Claim provisions are accounted for based on reports of experts or initial assessments of policyholders and experts. Reinsurers' shares of outstanding claims have been booked under technical reserves in reinsurers' share of outstanding claims account. Within the framework of the regulations regarding the change in the regulations on the principles of the establishment and operations of insurance and reinsurance companies issued in the Official Gazette No:25359 dated 27 January 2004, in each accounting period starting from 2004, insurance companies are required to calculate the outstanding claims adequacy ratio on a branch basis and to account for additional outstanding claims based on these ratios. Within this framework, when the average ratio for the past five years, excluding the current period, is less than 90%, insurance companies are required to account for additional outstanding claims for the difference between the calculated ratio and 90%. The Company's outstanding claims adequacy ratio has been calculated over 90% based on the past four years' data; consequently no additional provision for outstanding claims has been accounted for. Since the claims provision adequacy table given as an appendix of the article of The Undersecreteriat of the Treasury No:3821 dated 18 January 2005 does not contain life branch; the Company has not calculated claims provision adequacy ratio for life branch; in the case of personal accident branch, at 31 December 2006 since the last five years average outstanding claim provision adequacy ratio is over 90% at 31 December 2006, the Company has not been accounted for additional outstanding claim provision adequacy difference. In each accounting period starting from 2004, insurance companies are required to account for provisions for claims incurred but not reported at period-ends. The Company has accounted for an additional outstanding claims provision in the amount of YTL 700,884 (31 December 2005: YTL 611,816). Claims provision also includes accrued interest on claims that are brought to court for litigation, not yet finalized as of 31 December 2006. 11.8. Provision for premium receivables In accordance with the Insurance Supervisory Law and the related decrees issued by the Undersecretariat of the Treasury and published in the Official Gazette No:22153 dated 26 December 1994, effective from 1 January 1995, the Company calculates a provision for the Yap› Kredi Emeklilik A.fi. Notes To The Balance Sheet At 31 December 2006 And 2005 77 total amount of receivables from policyholders and agencies that are overdue for two months. The Company has calculated provision for premium receivables amounting to YTL 45,566 (31 December 2005: YTL 56,232. This amount has not been recorded; it has been considered to be immaterial). 11.9. Private pension operations At 31 December 2006, the Company has eleven pension investment funds. Private pension system receivables consist of capital advances made to pension investment funds, fund operating deductions made by the Company and receivables from Takasbank. In fund operating deductions account; the Company keeps funds operating expense deductions arising from fund management that are not collected on the same day. Advances allocated to pension investment funds established by the Company are recorded as capital advances made to pension investment funds. At 31 December 2006, Company does not have any capital advance on pension investment funds. Fund based receivables from Takasbank on behalf of participants are recognized in receivables from Takasbank account. At the same time, this amount is disclosed in the private pension system payables account as payables to participants for funds sold. In addition to payables to participants account, mentioned in the prior paragraph, private pension system payables also include to private pension intermediaries account and temporary accounts of participants. Temporary account of participants includes the contributions of participants that have not been invested yet. This account also includes the proceeds from the sale of participation shares less entrance fee deduction and similar charges, if any, in case the participant leaves the system or transfers its saving to other private pension companies. Fund management charge, which is charged in return for the fund management representation and other services provided to pension funds, is recorded as income in the Company's accounts and is shared between the Company and the fund manager according to the ratios specified in the agreement signed between the parties. The total charge is recorded to the Company's technical income as fund management charge and the part of charge which belongs to the fund manager is recorded in the Company's technical expense as the amount paid in return for fund management. Management expense deducted, which is deduction as 8% at most, from contributions made to participants’ private pension accounts, is followed under the management expense deduction account. The entrance fee income account includes the accrued balance when the participants enter the private pension system for the first time or when they open a new private pension account, not exceeding the monthly minimum wage at the date the private pension agreement is signed. 78 Yap› Kredi Emeklilik A.fi. Notes To The Balance Sheet At 31 December 2006 And 2005 In the Company's private pension plans, half of the entrance fee is collected in the year of the contract. The collection of the other half is deferred till the date the participants leave the private pension system or make a demand for transfer to another company within 10 years. For YTL contracts, the deferred portion of the entrance fee is increased with the inflation rate. Nonetheless, based on the entrance fee amount collected in the beginning, the Company contributes a continuity (loyalty) award, amounting to the deferred portion of the entrance fee which is fixed for foreign currency denominated contracts and the deferred portion of the entrance fee increased with the inflation for YTL contracts, to the private pension account of the participants on the condition that the participants hold their private pension account in the Company for 10 years without interruption. The changes in the value of the pension investment fund portfolio from the date the fund portfolio are created till the participants’ shares are sold completely are followed in the income statement as capital advance allowance interest income. According to the 4th clause of the internal regulations of funds; if all the participant shares in the Company's assets have not been returned to the funds in the six months following the offer for the sale of participant shares, those shares are required to be wholly returned to the funds by the end of the specified time period and the balance in return of the shares is required to be paid to the Company by the funds. 11.10. Marketable securities In accordance with the Insurance Chart of Accounts which came in force as of 1 January 2005 with the communiqué regarding the Insurance Chart of Accounts and Prospects, published in the Official Gazette No.25686 dated 30 December 2004, the Company classifies its marketable securities in 2 different groups as available-for-sale investments and trading investments. In that respect, interest income accruals and value increase or decreases arising from the revaluation of trading investments are realized in the statement of income. Availablefor-sale investments are valued at market value. The interest income accruals of these investments are realised in the statement of income, and the unrealized gains or losses arising from the change in the market values which amounts to YTL 810,002 (31 December 2005: YTL 1,146,744) are recorded under the equity account “Valuation of Financial Assets”. 95% of valuation difference on policyholders' asset, amounting to YTL 13,773,261 (31 December 2005: YTL 21,788,130), has been recorded under technical reserves (Notes to balance sheet: 27). 11.11. Financial assets The equity securities, investments and subsidiaries in the restated financial statements of the Company as of 31 December 2004 have been accounted with their restated values per the regulations of the Capital Markets Board (''CMB'') Communiqué XI No.25 in accordance with “Financial Reporting in Hyperinflationary Economies”. Notes To The Balance Sheet At 31 December 2006 And 2005 79 The restatement has been performed over the values as the revaluation fund arising from inflation adjustment and the financial expenses including the foreign exchange differences were deducted. The Company has booked provision for value decrease when the fair value of the financial asset is less than its restated value. 11.12. Tangible and intangible assets The tangible and intangible assets of the Company as of 31 December 2004 are accounted at the restated values calculated by multiplying the historic cost by the relevant conversion factor in accordance with the regulations in “Financial Reporting in Hyperinflationary Economies” stated in “Accounting Standards in Capital Markets” (Communiqué XI, No.25). Depreciation and amortisation on fixed assets has been calculated based on restated values using the straight-line depreciation method. When the carrying amount of each tangible and intangible asset implies a need for impairment adjustment, the carrying value is decreased down to its recoverable amount. According to the valuation report of Elit Gayrimenkul De¤erleme A.fi. as of 30 June 2006, the Company has cancelled YTL 380,734 of the YTL 818,083 impairment provision recorded at 1 January 2005 and has recognized this amount as income. Impairment provision of YTL 437,349 has been accounted based on the aforementioned report. Unearned premiums reserve As of 31 December 2006, the Company calculated unearned premium reserve as the unearned portion of written premiums net of agency commissions on a policy and daily basis. 11.14. Provision for employment termination benefits Under the current labor law, the Company is required to pay termination benefits to each employee who has completed one year of service and whose employment is terminated without due cause, is called up for military service, dies or who retires after completing 25 years of service (20 years for women). The amount payable consists of one month's salary limited to a maximum of YTL 1,857.44 (31 December 2005: YTL 1,727.15) for each period of service. The Company has allocated a full provision for employment termination benefits as of 31 December 2006 amounting to YTL 5,313,256 (31 December 2005: YTL 4,886,803) in allowance for employment termination benefits. 80 Yap› Kredi Emeklilik A.fi. Notes To The Balance Sheet At 31 December 2006 And 2005 11.15. Transactions in foreign currencies Transactions in foreign currencies during the year are translated into New Turkish lira at the exchange rates prevailing at the dates of the transactions. Balance sheet items (cash and cash equivalents, banks, marketable securities and payable balances) denominated in foreign currencies are translated at bid rates declared by the Central Bank of Turkey. Accrued premiums are translated at ask rates declared by the Central Bank of Turkey. The foreign exchange valuation differences are recorded to the related exchange gains and losses accounts. 11.16. Tax provision Corporation tax is payable at a rate of 20% (2005: 30%) on the total income of the Company and its subsidiaries registered in Turkey after adjusting for certain disallowable expenses, exempt income and investment and other allowances (e.g. research and development allowance). No further tax is payable unless the profit is distributed (except withholding tax at the rate of 19.8% on the investment incentive allowance utilized within the scope of the Income Tax Law transitional article 61). Dividends paid to non-resident corporations, which have a place of business in Turkey, or resident corporations are not subject to withholding tax. Otherwise, dividends paid are subject to withholding tax at the rate of 10%. An increase in capital via issuing bonus shares is not considered as a profit distribution and thus does not incur withholding tax. Corporations are required to pay advance corporation tax quarterly at the rate of 20% (2005: 30%) on their corporate income. Advance tax is declared by 10th of the second month following and payable by the 17th of the second month following each calendar quarter end. Advance tax paid by corporations is credited against the annual corporation tax liability. The balance of the advance tax paid may be refunded or used to set off against other liabilities to the government. In accordance with Tax Law No.5024 “Law Related to Changes in Tax Procedural Law, Income Tax Law and Corporate Tax Law” published in the Official Gazette on 30 December 2003 to amend the tax base for non-monetary assets and liabilities, effective from 1 January 2004 income and corporate taxpayers are required to prepare the statutory financial statements by adjusting the non-monetary assets and liabilities for the changes in the general purchasing power of the Turkish lira. In accordance with the Law in question, the cumulative inflation rate for the last 36 months and the inflation rate for the last 12 months must exceed 100% and 10%, respectively (TURKSTAT WPI increase rate). Since these conditions in question were not fulfilled in 2005 and 2006, no inflation adjustments were performed. There is no such application for the reconciliation of payable taxes with the tax authority. Corporate tax returns are submitted to the related tax office by the 25th day of the 4th month following the month when the accounting period ends. Yap› Kredi Emeklilik A.fi.
