Agraïments / Acknowledgements Johan Häggman Özlem Eraydin Virtanen Amb el suport de / With the support of: EDITORIAL Darrerement, l’ingrés de Turquia a la Unió Europea és una qüestió de debat. En aquests dies veiem com aquest país s’afanya a acostar-se a la UE després d’haver adoptat un nou codi penal. Segons alguns, aquest suposava l’últim obstacle a un informe de la Comissió Europea favorable a l’obertura de les negociacions sobre l’accés d’aquest país. Tanmateix, en matèria de drets de les minories i drets lingüístics a Turquia encara li queda alguna feina per fer. En aquest número del butlletí incloem dues regulacions aprovades pel Parlament turc: una fa referència a l’ensenyament de les diverses llengües i dialectes; l’altra es refereix a les emissions fetes per les institucions públiques i privades de ràdio i televisió en les diverses llengües i dialectes. Ambdues regulacions esmenen les anteriors (la primera esmena una regulació sobre el llenguatge de la Radio i la Televisió, Consell Suprem de Radio i Televisió, del 18 de desembre del 2002; publicada al Butlletí núm. 53; i l’altra esmena una regulació que porta el mateix títol, del 20 de setembre del 2002). De fet, aquestes esmenes mostren un tímid avenç pel que fa als drets lingüístics. D’altra banda, també ens fem ressò de l’esmena de la llei d’educació secundària superior de Finlàndia, adoptada pel parlament finès el 13 d’agost de 2004. La reforma, que en resum converteix el suec en llengua optativa, ha estat bastant controvertida i objecte de debat per part dels partits polítics de Finlàndia. Fins ara, en els exàmens finals dels estudis secundaris superiors, les proves de llengua materna i de la segona llengua del país (com el suec i el finès) eren obligatòries, mentre que segons la nova esmena només serà obligatòria la prova en llengua materna. Conseqüentment, la gran majoria de la població que té el finès com a llengua materna tindrà ara l’opció de no examinar-se de suec, tot fent que el coneixement d’aquesta llengua no sigui necessari. En canvi, és obvi que la població de parla sueca haurà d’aprendre finès necessàriament. Finalment, en el pla internacional presentem una sèrie de recomanacions del Comitè de Ministres del Consell d’Europa (CoE) sobre l’aplicació de la Carta Europea de les Llengües minoritàries o regionals per part de Dinamarca i Eslovènia. Pel que fa a Dinamarca, entre d’altres qüestions, el Consell demana l’aplicació pràctica de la Carta amb relació a l’alemany, especialment en els àmbits de l’administració, la justícia i els mitjans de comunicació, i recorda la possibilitat d’aplicar la Carta a les Illes Fèroe i Groenlàndia. Quant a Eslovènia, principalment el Consell sol·licita a les autoritats que reconsiderin el seu posicionament envers la llengua croata i que aclareixin la qüestió de la presència tradicional de les llengües sèrbia i bòsnia. EDITORIAL Lately, Turkey’s accession to the EU has raised debate. We can see that this country is making efforts to get closer to the EU, after having adopted a new penal code. According to some people, this constituted the last obstacle to a report by the European Commission in favour to the opening of the talks concerning Turkey’s accession. However, regarding minority and linguistic rights Turkey still has some job to do. In this issue of the Bulletin we include two regulations passed by the Turkish Parliament: one concerning the teaching of different languages and dialects, and the other concerning the broadcasting by the public and private radio and television companies in different languages and dialects. Both regulations amend the previous ones (the first one amends a regulation of the same title of December 18, 2002, published in Bulletin n. 53, and the second one amends also a regulation of the same title of September 20, 2002). Actually, the amends show a slight improvement concerning linguistic rights. On the other hand, we also publish the amendment of the Act on Upper Secondary School of th Finland, adopted by the Finish Parliament on 13 August 2004. The reform, which actually turns Swedish into a voluntary subject, has been quite controversial and has also raised debate among Finnish political parties. Until now, in the matriculation examination the tests in the mother tongue and in the second national language (i.e. Finish and Swedish) were compulsory, while in accordance with the new amendment only the test in the mother tongue will be compulsory. As a consequence, the great bulk of the population who have Finish as their mother tongue, will now have the choice not to be tested in Swedish, therefore making the knowledge of this language not necessary. By contrast, the need of the Swedish speaking population to learn Finish is more than obvious. Finally, in the international framework we present a series of recommendations by the Committee of Ministers of the Council of Europe (CoE) on the application of the European Charter for Regional and Minority Languages in Denmark and Slovenia. Regarding Denmark, the Council calls for the practical implementation of the Charter as regards German, especially in the fields of administration, justice and the media, and it reminds the possibility of applying the Charter on the Faroe Islands and on Greenland. Regarding Slovenia, the Council mainly asks the authorities to reconsider its position towards the Croatian language and to clarify the issue of the traditional presence of the Serbian and Bosnian languages. [Versió oficial en turc / Official version in Turkish] 5 Aralik 2003 Sayi: 25307 Milli Egitim Bakanligindan: TÜRK VATANDASLARININ GÜNLÜK YASAMLARINDA GELENEKSEL OLARAK KULLANDIKLARI FARKLI DIL VE LEHÇELERIN ÖGRENILMESI HAKKINDA YÖNETMELIK BIRINCI BÖLÜM Genel Hükümler Amaç Madde 1 — Bu Yönetmeligin amac i, Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin ögrenilmesine iliskin 8/6/1965 tarihli ve 625 sayili Özel Ögretim Kurumlari Kanununa göre açilabilecek özel kurslarin ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerinin açilis, isleyis ve denetim esaslarini düzenlemektir. Kapsam Madde 2 — Bu Yönetmelik, Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin ögrenilmesi amaciyla 625 sayili Özel Ögretim Kurumlari Kanununa göre açilabilecek özel kurslara ve 14/10/1983 tarihli ve 2923 sayili Yabanci Dil Egitim ve Ögretimi ile Türk Vatandaslarinin Farkli Dil ve Lehçelerinin Ögrenilmesi Hakkinda Kanun geregince Türkiye’de egitim ve ögretiminin yapilmasina Bakanlar Kurulunca karar verilen yabanci diller için açilan özel dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerine iliskin is ve islemleri kapsar. Dayanak Madde 3 — Bu Yönetmelik, 14/6/1973 tarihli ve 1739 sayili Millî Egitim Temel Kanunu, 8/6/1965 tarihli ve 625 sayili Özel Ögretim Kurumlari Kanunu, 30/7/2003 tarihli ve 4963 sayili Çesitli Kanunlarda Degisiklik Yapilmasina Iliskin Kanunla degistirilen 14/10/1983 tarihli ve 2923 sayili Yabanci Dil Egitimi ve Ögretimi ile Türk Vatandaslarinin Farkli Dil ve Lehçelerinin Ögrenilmesi Hakkinda Kanuna dayanilarak hazirlanmistir. Tanimlar Madde 4 — Bu Yönetmelikte geçen; a) Bakanlik: Millî Egitim Bakanligini, b) Kurs: Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin ögrenildigi kursu, c) Kursiyer: Kursa kayit olan kursiyerleri, d) Program: Bakanlikça onayli; adi, düzeyi ve süresi belirtilmis olan programi ifade eder. Kursun amaci Madde 5 — Kursun ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerinin amaci, Türk Millî Egitiminin genel amaçlarina ve temel ilkelerine uygun olarak Cumhuriyetin Anayasada belirtilen temel niteliklerine, Devletin ülkesi ve milletiyle bölünmez bütünlügüne aykiri olmayacak sekilde Türk vatandaslarinin, günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin ögrenilmesi için faaliyette bulunmaktir. IKINCI BÖLÜM Kurum Açma ve Ögretime Baslama Kurum açma ve ögretime baslama Madde 6 — Millî Egitim Bakanligi Özel Ögretim Kurumlari Yönetmeliginin "Kurum Açma" ve "Ögretime Baslama" izinlerinin verilmesine iliskin kosullarin yerine getirilmesi durumunda Bakanlikça kursa, "Kurum Açma" ve "Ögretime Baslama" izinleri verilir. Bakanliktan daha önce kurum açma ve ögretime baslama izinlerini alan dil kurslarina, Millî Egitim Bakanligi Özel Ögretim Kurumlari Yönetmeligine göre program ilâvesi yapilmasi hâlinde Türk vatandaslarinin, günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin ögrenilmesi amaciyla derslerin olusturulmasina izin verilir. Görevlendirme Madde 7 — Açilmasina izin verilen kursta; müdür, müdür yardimcisi, ögretmen veya usta ögretici ile diger personel görevlendirilir. Açilmis olan dil kurslarinda program ilâvesi ile ders olusturulmasi hâlinde bu dersler için ögretmen veya usta ögretici görevlendirilir. Farkli dil ve lehçelerin ögrenilmesi amaciyla kurslarda çalisma izni verilecek yönetici, ögretmen, uzman ögretici, usta ögretici ve diger personelin, 625 sayili Özel Ögretim Kurumlari Kanunu ve Millî Egitim Bakanligi Özel Ögretim Kurumlari Yönetmeligi ile Millî Egitim Bakanligi Özel Kurslar Tip Yönetmeliginde belirtilen genel nitelik ve kosullari tasimasi gerekir. Görevlendirilecek diger personele 625 sayili Özel Ögretim Kurumlari Kanunu ile Millî Egitim Bakanligi Özel Ögretim Kurumlari Yönetmeligi hükümlerine göre çalisma izni verilir. Kayit-kabul esaslari Madde 8 — Kurslara ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerine, en az ilkögretim ve orta ögretim kurumlarinda okuyan, mezun olan veya orta ögretim kurumlarindan ayrilan ögrencilerle yetiskinler alinir. Ilkögretim çaginda oldugu hâlde okula devam etmeyenler, kursa alinmaz. Okul öncesi veya ilkögretim çagindaki engelli çocuklarin, yas ve ögrenim durumlarina bakilmaz. Kurslar arasinda kursiyer nakli yapilmaz. Kayit-kabulde istenecek belgeler Madde 9 — Kayit kabulde istenecek belgelerde Millî Egitim Bakanligi Özel Kurslar Tip Yönetmeligi hükümleri uygulanir. Ögretim programi Madde 10 — Kursta ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerinde, Bakanlikça uygun bulunan ögretim programlari uygulanir. ÜÇÜNCÜ BÖLÜM Çesitli Hükümler Denetim Madde 11 — Denetim, Millî Egitim bakanligi Özel Ögretim Kurumlari Yönetmeligi hükümlerine göre yapilir. Kilik-kiyafet Madde 12 — Kurslarda ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerinde; kurucu, kurucu temsilcisi, yönetici, ögretmen ve diger personel hakkinda; 22/7/1981 tarihli ve 8/3349 sayili Bakanlar Kurulu Karariyla yürürlüge konulan "Millî Egitim Bakanligi ile Diger Bakanliklara Bagli Okullardaki Görevlilerle Ögrencilerin Kilik-Kiyafetlerine Iliskin Yönetmelik" hükümleri, kursa ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerine devam eden kursiyerler hakkinda ise resmî yaygin egitim kurumlarina iliskin hükümler uygulanir. Karma ögrenim Madde 13 — Kurslarda ve diger dil kurslarinda ayni maksatla olusturulan dil ve lehçe derslerinde, 14/6/1973 tarihli ve 1739 sayili Millî Egitim Temel Kanununun 15 inci maddesi ile Millî Egitim Bakanligina Bagli Özel Ögretim Kurumlari Yönetmeliginin 5 inci maddesine uygun olarak karma ögrenim yapilir. Günlük çalisma saatleri Madde 14 —Kurslar çalismalarini 7.00 ile 24.00 saatleri arasinda sürdürür. Bir ders saati süresi 45 dakikadir. Uygulamali dersler blok hâlinde 90 dakika olarak yapilabilir. Kurslarda resmî bayram günlerinde ögretim yapilmaz. Diger hususlar Madde 15 — Bu Yönetmelikte yer almayan hususlarda, Millî Egitim Bakanligi Özel Ögretim Kurumlari Yönetmeligi ile Millî Egitim Bakanligi Özel Kurslar Tip Yönetmeligi hükümleri uygulanir. Yürürlükten kaldirilan mevzuat Madde 16 — Bu Yönetmeligin yürürlüge girdigi tarihten itibaren; 20/9/2002 tarihli ve 24882 sayili Resmî Gazete’de yayimlanan "Türk Vatandaslarinin Günlük Yasamlarinda Geleneksel Olarak Kullandiklari Farkli Dil ve Lehçelerin Ögrenilmesi Hakkinda Yönetmelik" yürürlükten kaldirilmistir. Yürürlük Madde 17 — Bu Yönetmelik, yayimi tarihinde yürürlüge girer. Yürütme Madde 18 — Bu Yönetmelik hükümlerini, Millî Egitim Bakani yürütür. [Unofficial translation into English] [Source: The Ministry of Education] Official Gazette – 5 December 2003 No. 25307 REGULATION ON THE TEACHING OF THE DIFFERENT LANGUAGES AND DIALECTS TRADITIONALLY USED BY T URKISH CITIZENS IN THEIR DAILY LIVES SECTION ONE General Provisions Purpose Article 1 – The purpose of this regulation is to devise the principles of opening, functioning and supervision of the private courses and other language courses, which can be opened in accordance with the Law No. 625 on the Private Educational Institutions, dated 8/6/1965, for teaching different languages and dialects that are traditionally used by Turkish citizens in their daily lives. Content Article 2 – This Regulation covers the private courses, which can be opened in line with Law No. 625 on opening private courses to teach different languages and dialects traditionally used by Turkish citizens in their daily lives and the same functions and procedures for the language and dialect lessons which the Council of Ministers has decided for the education and teaching of different languages and dialects in line with Law No. 2923 on Foreign Language Education and Teaching and Teaching Different Languages and Dialects to Turkish citizens. Basis Article 3 – This Regulation has been prepared on the basis of Law No. 1739, the Fundamental National Education Law (dated 14/6/1973), on Law No. 625 on the Private Education Institutions and on Law No. 4963 on Amending Various Laws, which amended Law No. 2923 (dated 14/10/1983) on the Foreign Language Education and Teaching and Teaching Turkish Citizens Different Languages and Dialects. Definitions Article 4 – The expressions in this Regulation mean the following: a) Ministry: Ministry of Education b) Course: The course teaching different languages and dialects traditionally used by Turkish citizens in their daily lives c) Student: Students registered to the course d) Program: The program which is approved by the Ministry and the name, the level and the duration of which has been determined Purpose of the Course Article 5 – The purpose of the course and the other language courses in language and dialects taught for the same reason, is to conduct activities in order to teach different languages and dialects that are traditionally used by Turkish citizens in their daily lives. The courses shall be in line with general aims and fundamental principles of the Turkish national education and the fundamental qualifications of the Republic stated in the Constitution and shall be conducted in a manner not to violate the indivisible integrity of the State with its country and nation. SECTION TWO Opening the Institution and Starting Teaching Opening the Institution and Starting Teaching Article 6 – Upon fulfilling the conditions for the permission of “Opening the Institution” and “Starting Teaching” in the Regulation of the Private Teaching Institutions of the Ministry of Education, the Ministry grants the permissions for “Opening the Institution” and for “Starting Teaching”. In case the language courses, which have previously taken permission from the Ministry to open the institution and to start teaching, furnishes additional program in line with the Regulation of the Private Teaching Institutions of the Ministry of Education, permission shall be granted so that they can teach different languages and dialects traditionally used by Turkish citizens in their daily lives. Appointment Article 7 – The courses, which have been granted the permission to open, shall appoint a director, a deputy director, teacher or senior teaching staff and other personnel. In case of newly formed classes with the additional program in the language courses, which have previously been opened teachers or senior teaching staff shall be assigned for these classes. The administrators, teachers, expert and senior teaching staff and other personnel, who will be granted work permits in the courses to teach different languages and dialects shall have the general qualifications and conditions stated in Law No. 625 on Private Teaching Institutions and the Regulation on Private Teaching Institutions of the Ministry of Education and the Prototype Regulation of the Private Courses of the Ministry of Education. Other personnel will be granted permission in line with the provisions of Law 625 on Private Teaching Institutions and of the Regulation on Private Teaching Institutions of the Ministry of Education. Principles of Acceptance and Registration Article 8 – Students who are enrolled or graduated from at least in primary and secondary educational institutions or who have dropped out of secondary educational institutions, or adults shall be accepted to the courses and to the other language courses or to language and dialect classes formed for the same purpose. The age and the educational status of the pre-school children and handicapped children at the level of primary education are not taken into consideration. Students shall not be transferred between courses. Documents to be requested at the Acceptance-Registration Stage Article 9 – For the documents to be requested at the acceptance-registration stage, the provisions stated in the Prototype Regulation of Private Courses of the Ministry of Education are implemented. Teaching Program Article 10 – The teaching programs approved by the Ministry are implemented in the course and in other language courses and in the language and dialect lessons formed for the same purpose. SECTION THREE Various Provisions Supervision Article 11 – Supervisions shall be held in line with the provisions of the Regulation on the Private Teaching Institutions of the Ministry of Education. Dress Code Article 12 – In the courses and in other language courses and in the language and dialect lessons formed for the same purpose, for the founder of the course, for the representative of the founder, for teachers and other staff the provisions of the “Regulation on Dress Code for the Staff and Students of the Schools Affiliated to the Ministry of Education and to other Ministries”. For the students attending the courses and other language courses and the language and dialect lessons formed for the same purpose, the provisions for the dress code in official educational institutions will be implemented. Co-education Article 13 – In line with Article 15 of Law No 1739 on the Fundamental Education Law, dated 14/6/1973, and with Article 5 of the Regulation on Private Educational Institutions Affiliated to the Ministry of Education, the courses and other language courses and language and dialect lessons formed for the same purpose shall be co-educational. Daily working hours Article 14 – The work in the courses will be conducted between 07:00 and 24:00. One class hour is 45 minutes. Practical classes can be held in a block of 90 minutes. No teaching will be done in the courses during the official holidays. Other points Article 15 – For points, which are not covered in this Regulation, the provisions stated in the Regulation on the Private Educational Institutions of the Ministry of Education and the Prototype Regulation for the Private Courses of the Ministry of Education shall be implemented. Annulled rules and regulations Article 16 – As per the date when this Regulation is put into effect, the “Regulation on Teaching Different Languages and Dialects Traditionally used by Turkish Citizens in their Daily Lives”, published in the Official Gazette no 24882, dated 20/9/2002, has been annulled. Effectiveness Article 17 – This Regulation will be effective as per the date of its publication. Execution Article 18 – The Minister for Education executes the provisions of this Regulation. Àmbit Article 2 – Aquesta regulació s’aplica als cursos privats, que es poden realitzar d’acord amb la Llei núm. 625 de creació de cursos privats, per a l’ensenyament de les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària, amb les mateixes funcions i procediments per a classes de llengües i dialectes que el Consell de Ministres ha decidit aplicar a l’educació i l’ensenyament de les diverses llengües i dialectes d’acord amb la Llei núm. 2923 d’educació i ensenyament de llengües estrangeres i aprenentatge de diverses llengües i dialectes per part dels ciutadans turcs. Justificació Article 3 – Aquesta regulació ha estat elaborada en virtut de la Llei fonamental de l’educació nacional núm. 1739, del 14 de juny de 1973, la Llei núm. 625 d’institucions educatives privades i la Llei núm. 4963 d’esmena de diverses lleis, la qual va esmenar la Llei núm. 2923 d’educació i ensenyament de llengües estrangeres i aprenentatge de diverses llengües i dialectes per part dels ciutadans turcs. Definicions Article 4 –Els termes inclosos a la següent regulació tenen el següent significat: e) Ministeri: Ministeri d’Educació f) Curs: el curs d’ensenyament de les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària g) Alumne: l’alumne matriculat al curs h) Programa: el programa que ha estat aprovat pel Ministeri, així com també el seu nom, el seu nivell i la seva durada establerts. L’Objectiu del curs Article 5 – L’objectiu del curs i d’altres cursos de llengües i dialectes és el de dur a terme activitats per ensenyar les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària. Els cursos es desenvoluparan d’acord amb els objectius generals i els principis fonamentals de l’educació nacional turca i amb els atributs fonamentals de la República, establerts a la Constitució, i es duran a terme sense violar la integritat indivisible de l’Estat, amb el seu país i nació. SECCIÓ IIª Establiment de les institucions i inici de les classes Establiment de les institucions i inici de les classes Article 6 – Quan s’hagin assolit les condicions a les que fa referència la Regulació d’institucions privades reconegudes pel Ministeri d’Educació referent a les llicències per a “l’establiment d’institucions” i “l’inici de les classes”, el Ministeri expedirà les llicències per a “l’establiment d’institucions” i “l’inici de les classes”. En el cas que els cursos de llengües que prèviament hagin obtingut la llicència per establir la institució i iniciar les classes per part del Ministeri ofereixin un programa addicional d’acord amb la Regulació d’institucions privades reconegudes pel Ministeri d’Educació, s’atorgarà el permís perquè ensenyin les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària. Designacions Article 7 – El director, el subdirector, el professorat interí, el professorat titular, així com també personal d’altra mena, seran designats per als cursos per als quals s’hagi expedit una llicència. Per a les noves classes que tinguin un programa addicional en cursos de llengua prèviament establerts es designarà el professorat titular. Els administradors, el professorat interí, el professorat titular i el personal d’altra mena als quals se’ls atorgarà permisos de treball per ensenyar les diverses llengües i dialectes hauran de posseir les qualificacions i condicions generals estipulades a la Llei núm. 625 d’institucions educatives privades i a la Regulació d’institucions educatives privades reconegudes pel Ministeri d’Educació, així com també a la Regulació prototip de cursos privats del Ministeri d’Educació. L’obtenció del permís per part del personal d’altra mena es farà d’acord amb les disposicions de la Llei núm. 625 d’institucions educatives privades i amb la Regulació d’institucions educatives privades del Ministeri d’Educació. Normes de matriculació Article 8 – Seran acceptats als cursos, als cursos d’altres llengües i a les classes de llengües i dialectes concebudes per a les mateixes finalitats els alumnes matriculats o graduats almenys en institucions d’educació primària i secundària, els que hagin abandonat les institucions d’educació secundària o els adults. No es prendrà en consideració ni l’edat ni el nivell educatiu dels alumnes d’educació infantil ni dels d’educació primària que tinguin discapacitats. Els alumnes no podran passar d’un curs a un altre. Documentació necessària per a la matriculació Article 9 – Pel que fa a la documentació necessària per a la matriculació s’aplicaran les disposicions establertes a la Regulació prototip de cursos privats del Ministeri d’Educació. Programes educatius Article 10 – Els programes educatius aprovats pel Ministeri s’aplicaran al curs, a d’altres cursos de llengua i a les classes de llengües i dialectes concebudes per a les mateixes finalitats. SECCIÓ III Disposicions diverses Control Article 11 – El control dels cursos serà dut a terme d’acord amb les disposicions de la Regulació d’institucions privades reconegudes pel Ministeri d’Educació. Normes d’indumentària Article 12 – Pel que fa als cursos i en altres cursos de llengua, així com a classes de llengües i dialectes concebudes per a les mateixes finalitats, les disposicions de la “Regulació sobre les normes d’indumentària per al personal i els alumnes de les escoles reconegudes pel Ministeri d’Educació Nacional i altres ministeris”, s’aplicaran al fundador, al representant del fundador, al professorat i altre personal. A les institucions educatives oficials les disposicions sobre les normes d’indumentària seran aplicades als alumnes matriculats als cursos i en altres cursos de llengua, així com a classes de llengües i dialectes concebudes per a les mateixes fi nalitats. Coeducació Article 13 – Els cursos i altres cursos de llengua, així com les classes de llengües i dialectes concebudes per a les mateixes finalitats seran de tipus coeducatiu, d’acord amb l’article 15 de la Llei núm. 1739 de les normes fonamentals de l’educació, del 14 de juny de 1973, i l’article 5 de la Regulació de les institucions educatives privades reconegudes pel Ministeri d’Educació. Horari lectiu diari Article 14 – Les activitats dels cursos es desenvoluparan entre les 7:00 i les 24.00 hores. La durada de cada classe serà de 45 minuts. Els classes pràctiques es podran dur a terme en un bloc de 90 minuts. Durant els dies de festa nacional no s’impartiran classes. Altres aspectes Article 15 – Els punts que no estiguin contemplats en aquesta Regulació es regularan a través de les disposicions establertes a la Regulació d’institucions educatives privades reconegudes pel Ministeri d’Educació i a la Regulació prototip de cursos privats del Ministeri d’Educació. Normes i regulacions anul·lades Article 16 – Amb l’entrada en vigor d’aquesta Regulació queda anul·lada la “Regulació sobre l'aprenentatge de llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària”, publicada al Diari Oficial núm. 24882, del 20 de setembre de 2002. Entrada en vigor Article 17 –Aquesta regulació entrarà en vigor el dia de la seva publicació. Aplicació Article 18 – Les disposicions d’aquesta normativa seran aplicades pel Ministeri d’Educació. [Versió oficial en turc / Official version in Turkish] 25.1.2004 Sayi: 25357 Radyo ve Televizyon Üst Kurulundan: TÜRK VATANDASLARININ GÜNLÜK YASAMLARINDA GELENEKSEL OLARAK KULLANDIKLARI FARKLI DIL VE LEHÇELERDE YAPILACAK RADYO VE TELEVIZYON YAYINLARI HAKKINDA YÖNETMELIK BIRINCI BÖLÜM Amaç, Dayanak, Tanimlar Amaç Madde 1 – Bu Yönetmeligin amaci, kamu ve özel radyo ve televizyon kuruluslarinin radyo ve televizyon yayinlarinin Türkçe yapilmasi esasi yaninda Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde de yayin yapabilmelerine iliskin usul ve esaslari düzenlemektir. Dayanak Madde 2 – Bu Yönetmelik, 3984 sayili Radyo ve Televizyonlarin Kurulus ve Yayinlari Hakkinda Kanunun 4928 sayili Kanunla degisik 4 üncü maddesine ve Avrupa Sinir Ötesi Televizyon Sözlesmesinde öngörülen hükümlere dayanilarak hazirlanmistir. Tanimlar Madde 3 – Bu Yönetmelikte geçen; a) Üst Kurul: Radyo ve Televizyon Üst Kurulunu, b) Kanun: 3984 sayili Radyo ve Televizyonlarin Kurulus ve Yayinlari Hakkinda Kanunu, c) Iletisim Ortami: Radyo ve televizyon programlarinin üretildigi merkez çikisindaki sinyali herhangi bir teknik kullanarak tek veya birden fazla radyo ve televizyon yayinini bir arada olarak radyo, televizyon alicilari ve/veya veri dagitim merkezlerine ileten her nevi ortami, d) Tematik Kanal: Haber, belgesel, spor, müzik ve benzeri türlerde olmak üzere yalnizca belli bir konuda yayin yapan kanali, e) Ulusal Yayin: Bütün ülkeye yapilan radyo, televizyon ve veri yayinini, f) Bölgesel Yayin: Birbirine komsu en az üç il ve en çok bir cografi bölge alaninin asgari yüzde yetmisine yapilan radyo, televizyon yayinini, g) Yerel Yayin: Mülki taksimat itibariyla en az bir ilçe (merkez ilçe dahil) veya bir ilin alaninin en az yüzde yetmisine yapilan radyo, televizyon ve veri yayini, h) Yeniden Iletim: Yetkili yayin kurulusu tarafindan kullanilan teknik araç ne olursa olsun, halkin izlemesi amaciyla yayinlanan radyo ve televizyon program hizmetlerinin degisiklik yapilmaksizin bütününün veya bir bölümünün alinmasi ve ayni anda veya teknik nedenlerle bagli olarak daha sonra iletilmesini, i) Haber: Kamuoyunun bilgi edinme ihtiyacini karsilamak amaciyla ve nesnel bir bakis açisiyla izleyici ve dinleyicilere iletilen güncel, toplumsal, siyasal, kültürel, ekonomik olay, konu ve gelismeleri, j) Haber Programlari: Kamuoyunun bilgi edinme ihtiyacini karsilamak amaciyla olay, konu ve gelismeleri ayrintilariyla ele alan ve degerlendiren; olagandisi durumlar disinda belirli yayin gün ve saatinde ve genellikle belirli bir süreyle sinirli olarak, düzenli biçimde izleyici ya da dinleyicilere sunulan program türünü, k) Haber Bülteni: Kamuoyunun bilgi edinme ihtiyacini karsilamak amaciyla, güncel, toplumsal, siyasal, kültürel, ekonomik olay, konu ve gelismelerin, basin ve yayin meslek ilkeleri uyarinca, dogruluk ve çabukluk ilkesine uygun olarak izlenip, derlenerek, izleyici veya dinleyicilere, olagandisi durumlar hariç düzenli olarak, belirli saatlerde sunuldugu program türünü, l) Kültür Programlari: Toplumun düsünce ve hayat sekline konu teskil eden ve nesilden nesle aktarilan inanç, bilgi ve uygulamalarin korunmasi, gelistirilmesi, yayilmasi ve zenginlestirilmesi amaciyla milli kültür politikasinin ilkeleri dogrultusunda hazirlanan programlari, m) Müzik Programlari: Kültürel zenginligin bir parçasi olan her türlü sözlü ve/veya sözsüz müzik eserlerinin icra edildigi programlari, n) Yayin Plani: Kanun ve bu Yönetmelik uyarinca, yayincinin, yayinlarin gün, saat ve sürelerini belirtmek üzere hazirlayacagi yayin düzenini, o) Yillik Yayin Dönemi: Her yilin 01 Ocak günü Türkiye saatiyle 00.00’da baslayip 31 Aralik günü saat 24.00’de sona eren zaman dilimini, p) Aylik Yayin Dönemi: Her ayin birinci günü Türkiye saatiyle 00.00’da baslayip son günü saat 24.00’de sona eren zaman dilimini, r) Yayin Günü: Türkiye saatiyle 00.00’dan baslayan 24 saatlik zaman dilimini, s) Yayin Saati: Yayin yapilacak saatleri ve münferit programlarin yayinlanma saatlerini, t) Alt Yazi: Program kaydi veya yayin esnasinda, çogunlukla ekranin alt bölümüne yerlestirilen, sabit ve/veya hareketli olarak verilen yazili bilgileri ifade eder. IKINCI BÖLÜM Yayinlarin Dili, Yayin Esaslari, Basvuru Yayinlarin dili Madde 4 – Yayinlarin Türkçe yapilmasi esastir. Yayinlarda Türkçe’nin özellikleri ve kurallari bozulmadan konusma dili olarak kullanilmasi, çagdas kültür, egitim ve bilim dili olarak gelismesi saglanmalidir. Münhasiran Türkçe’den baska bir dil ve lehçede yayin yapilamaz. Ancak, bu yönetmelik çerçevesinde Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde de yayin yapilabilir. Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde yayin esaslari Madde 5 – Kamu ve özel ulusal radyo ve televizyon kuruluslarinca Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde de bu Yönetmelik hükümleri dogrultusunda Üst Kurul’dan izin almak suretiyle yayin yapilabilir. Bu dil ve lehçelerde sadece yetiskinler için haber, müzik ve geleneksel kültürün tanitimina yönelik yayinlar yapilabilir. Bu dil ve lehçelerin ögretilmesine yönelik yayin yapilamaz. Kamu ve özel ulusal yayin lisansi sahibi radyo ve televizyon kuruluslari, bu dil ve lehçelerdeki yeniden iletim konusu yayinlari da dahil olmak üzere; radyo kuruluslari günde 60 dakikayi asmamak üzere haftada toplam bes saat, televizyon kuruluslari ise günde 45 dakikayi asmamak üzere haftada toplam dört saat yayin yapabilirler. Bu dil ve lehçelerde yeniden iletim konusu yayinlar dahil, televizyon yayini yapan kuruluslar bu yayinlarini içerik ve süre açisindan bire bir olmak kaydiyla, Türkçe alt yaziyla vermekle veya hemen akabinde Türkçe tercümesini yayinlamakla, radyo yayini yapan kuruluslar ise programin yayinlanmasini takiben Türkçe tercümesini yayinlamakla yükümlüdürler. Basvuru Madde 6 – Kamu ve özel radyo ve televizyon kuruluslari; a) Yayin yapmak istedikleri, dil ve/veya lehçeyi, bu dil ve lehçede yayinlanacak program türlerini, bu programlarin, günlük yayin akisi içindeki yerlesimini, aylik ve yillik yayin planlarini belirleyen, kurulusun yönetim kurulu karari, b) Münhasiran bu yayinlarla ilgili denetleme kurulu, sorumlu müdür, haber biriminde çalisanlar ve spikerlerin 3984 sayili Kanun ve Yönetmeliklerde aranilan vasiflari tasidiklarina dair belge, c) Taahhütnamenin kurulusun tüzel kisiligini temsile yetkili kisi tarafindan noter huzurunda imzalanmis örnegi ile, Üst Kurula basvururlar. Basvurudan sonra meydana gelen degisiklikler de Üst Kurul’a bildirilir ve onayi alinir. ÜÇÜNCÜ BÖLÜM Degerlendirme, Izin, Yükümlülükler Degerlendirme, izin Madde 7 – Üst Kurul, Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde yayin yapmak isteyen kamu ve özel yayin kuruluslarinin basvurularindaki bilgi ve belgeleri inceler ve bu yönetmelik hükümlerini yerine getiren kuruluslara yayin izni verir. Türkçe yayin yapan yayin kuruluslarinin, günlük, aylik ve yillik yayin planlari göz önüne alindiginda süreklilik arz etmeyen münferit müzik eserlerinin yayinlari ve sinema filmlerine yer verilmesi bu izin kapsami disinda degerlendirilir. Yayin kuruluslarinin basvurusunun Üst Kurulca reddi kararlarina karsi yargi yolu açiktir. Yükümlülükler Madde 8 – Türkçe’den baska bir dilde de yayin yapmak üzere Üst Kuruldan izin alan yayin kuruluslari yayinlarini; hukukun üstünlügüne, Anayasanin genel ilkelerine, temel hak ve özgürlüklere, milli güvenlige, genel ahlaka, Cumhuriyetin Anayasada belirtilen temel niteliklerine, Devletin ülkesi ve milletiyle bölünmez bütünlügüne, 3984 sayili Kanun ve bu Kanuna dayanilarak çikartilan yönetmeliklerle düzenlenen esas ve ilkelere, Üst Kurulun öngördügü yükümlülüklere izin sartlari ve taahhütlerine uygun olarak kamu hizmeti anlayisi çerçevesinde yapmakla yükümlüdürler. Yayin kuruluslari farkli dil ve lehçelerde yaptiklari yayin süresince stüdyo düzeni, mevcut logo, ses efekti ve tanitici ses isaretleri disinda simgelere yer vermemekle yükümlüdürler. Gerektigi takdirde, sadece Türkiye Cumhuriyeti’nin simgesi niteligindeki görüntü ve isaretler kullanilabilir. DÖRDÜNCÜ BÖLÜM Müeyyideler Müeyyideler Madde 9 – Kanundaki esaslara, yayin ilkelerine ve Üst Kurulca öngörülen yükümlülüklere aykiri yayin yapan yayin kuruluslari 3984 sayili Kanunun 33 üncü maddesi hükmü uyarinca cezalandirilir. Üst Kurulun izni olmadan Türkçe’den baska bir dil ve lehçede yayin yapan yayin kuruluslarina 3984 sayili Kanunun Ek-2 maddesi hükmü uyarinca izinsiz yayin müeyyidesi uygulanir. Üst Kurul’ca yayin kuruluslarina uygulanacak müeyyidelere karsi yargi yolu açiktir. BESINCI BÖLÜM Çesitli Hükümler Madde 10 – Bu Yönetmelikte hüküm bulunmayan hallerde 3984 sayili Radyo ve Televizyonlarin Kurulus ve Yayinlari Hakkindaki Kanuna dayanilarak çikartilan yönetmeliklerin ilgili hükümleri uygulanir. Madde 11 – 18/12/2002 tarihli ve 24967 sayili Resmî Gazetede yayimlanan Radyo ve Televizyon Yayinlarinin Dili Hakkinda Yönetmelik yürürlükten kaldirilmistir. Geçici Madde 1 – Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerin izleyici-dinleyici profili belirleninceye kadar bu dil ve lehçelerdeki yayin sadece kamu ve özel ulusal yayin kuruluslari tarafindan yapilir. Üst Kurul ülke çapindaki talepler yaninda, gerekli arastirmalar yaptirarak izleyici-dinleyici profilini çikarir. ALTINCI BÖLÜM Yürürlük ve Yürütme Yürürlük Madde 12 – Bu Yönetmelik, yayimi tarihinde yürürlüge girer. Dayanak Madde 2 – Bu Yönetmelik, 3984 sayili Radyo ve Televizyonlarin Kurulus ve Yayinlari Hakkinda Kanunun 4771 sayili Kanunla degisik 4 üncü maddesine dayanilarak hazirlanmistir. Tanimlar Madde 3 – Bu Yönetmelikte geçen; a) Üst Kurul: Radyo ve Televizyon Üst Kurulunu, b) TRT: Türkiye Radyo –Televizyon Kurumunu, c) Kanun: 3984 sayili Radyo ve Televizyonlarin Kurulus ve Yayinlari Hakkinda Kanunu, d) Veri yayini: Radyo ve televizyon yayini ile birlikte, radyo ve televizyon programlariyla ilintili veya radyo ve televizyon programlarindan bagimsiz verilen, elektromanyetik dalgalar, veri sebekeleri ve diger yollarla halkin dogrudan almasi maksadiyla yapilan yayinlari, ifade eder. IKINCI BÖLÜM Yayinlarin Dili Yayinlarin Dili Madde 4 – Yayinlarin Türkçe yapilmasi esastir. Yayinlarda Türkçe’nin özellikleri ve kurallari bozulmadan konusma dili olarak kullanilmasi, çagdas kültür, egitim ve bilim dili olarak gelismesi saglanmalidir. Türk Vatandaslarinin Kullandiklari Geleneksel Dil ve Lehçelerde Yayin Madde 5 – Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde de yayin yapilabilir. Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerdeki yayin, Türkiye Radyo-Televizyon Kurumu tarafindan yapilir. Bu dil ve lehçelerde yetiskinler için haber, müzik ve kültürel alanda bir veya birkaç dil veya lehçede yayin yapilabilir. Bu dil ve lehçelerin ögretilmesine yönelik yayin yapilamaz. Üst Kurul ile TRT arasinda düzenlenecek bir protokolle Radyo ve Televizyon Üst Kurulu’nun maddi katkilari ve TRT’nin olanaklari ölçüsünde, mülki amirlerin görüs ve talepleri de dikkate alinarak, bu dil ve lehçelerde yayin yapilmasi ve bu yayinlarin izleyici-dinleyici profilinin belirlenmesine yönelik çalisma yapilmasi saglanir. TRT tarafindan bu dil ve lehçelerde yapilan yayinlar hakkinda bu Yönetmelik ile protokol hükümleri uygulanir. Bu dil ve lehçelerde yapilacak radyo yayinlari günde kirkbes dakikayi ve haftada toplam dört saati, televizyon yayinlari günde otuz dakikayi ve haftada toplam iki saati asamaz. Televizyon yayinlarinda içerik ve süre açisindan bire bir olmak kaydiyla, programlar Türkçe alt yaziyla, radyo yayinlarinda ise programin yayinlanmasini takiben Türkçe tercümesi verilmek suretiyle yapilir. Basvuru Madde 6 – Türkiye Radyo-Televizyon Kurumu; izleyici-dinleyici profiline göre yapilacak olan televizyon ve radyo programlarinin yayin alani, dil ve lehçeleri bu dil ve lehçelerde yayinlanacak haber, müzik, kültür yayin türlerini, haftanin hangi gün ve/veya günlerinde yayinlanacagini, günlük yayin akisi içindeki yerlesimini, aylik ve yillik yayin planlarini belirleyen yönetim kurulu karari ile münhasiran bu yayinlarla ilgili denetleme kurulu, sorumlu müdür, haber biriminde çalisanlar ve spikerlerin 3984 sayili Kanun ve yönetmeliklerde aranilan vasiflari tasidiklarina dair belgeleri eklemek sureti ile Üst Kurul’a basvurur. ÜÇÜNCÜ BÖLÜM Degerlendirme, Izin ve Yükümlülükler Degerlendirme ve Izin Madde 7 – Hangi dil ve lehçe ve/veya dil ve lehçelerde yayin yapilacagi, yayin alani, izleyici-dinleyici profiline göre Üst Kurul tarafindan degerlendirilir. Üst Kurul, Türk vatandaslarinin günlük yasamlarinda geleneksel olarak kullandiklari farkli dil ve lehçelerde yayin yapacak TRT Kurumu’nun basvurusundaki bilgi ve belgelere bagli kalmaksizin ilgili resmi mercilerden resen bilgi ve belge temin etmek suretiyle izin kosullarini degerlendirir. [Unofficial translation into English] [Source: Radio and Television Supreme Board] Official Gazette – 25 January 2004 No. 25357 REGULATION CONCERNING RADIO AND TELEVISION BROADCASTS IN LANGUAGES AND DIALECTS USED TRADITIONALLY BY TURKISH CITIZENS IN THEIR DAILY LIVES SECTION ONE Objective, Justification and Definitions Objective Article 1 – The objective of this regulation is to regulate the procedures and principles relating to broadcasts made by public and private radio and television institutions in the different languages and dialects traditionally used by Turkish citizens in their daily lives in addition to radio, television and broadcasts in Turkish. Justification Article 2 – This Regulation has been prepared based on Article 4 of Law no. 3984 on the Establishment and Broadcasts of Radios and Televisions amended by Law no. 4771 and on provisions included in the European Convention on Transfrontier Television. Definitions Article 3 – Of the terms used in this Regulation; a) The Supreme Board: denotes the Radio and Television Supreme Board, b) Law: denotes Law no. 3984 on the Establishment and Broadcasts of Radios and Televisions, c) Communication Medium: denotes every kind of medium that transmits the signal produced by the center that produces radio and television programs, of one or more than one radio or television broadcast or together, using any kind of technique, to a radio, television receivers and/or data distribution centers, d) Thematic Channel: denotes a channel that broadcasts only on a specific subject such as news, documentary, sport, music and in related kinds, e) National Broadcast: denotes radio, television and data broadcasts made to all the country f) Regional Broadcast: denotes radio, television broadcast made to at least three neighboring provinces and to a minimum of a seventy percent area of a geographical region at the most, g) Local Broadcast: denotes radio, television or data broadcast made in consideration of the civil partition, to at least one sub-province (central sub-province included) or at least to seventy percent area of a province, h) Re-transmission: denotes, taking all or a part of the radio and television program services without making any changes, and the transmitting of it at the same instant or at a later time depending on technical reasons in order for the public to watch, what ever the technical apparatuses used by the authority broadcasting institutions, i) News: denotes actual, social, political, cultural, economical event, subjects and developments transmitted by means of an objective view to viewers or listeners in order to meet the needs of the public to obtain information j) News Programs: denotes the transmission of detailed and evaluated subjects and developments program type, presented to viewers or listeners excluding extraordinary situations in defined broadcasting day and hours and usually in a certain period of time in order to meet the needs of the public to obtain information k) News Bulletin: denotes program type actual, social, political, cultural, economical event, subjects and developments transmitted in the principals of press and broadcasting occupation, watched, collected, in accordance to true and fast principals presented to viewers and listeners in certain hours excluding extraordinary situations in order to meet the needs of the public to obtain information l) Cultural Programs: denotes programs prepared to preserve, improve, distribute and richen the belief, knowledge and practices which are subjected to the thought and life of the public and which are passed from generation to generation, in the course of the national culture policy principals m) Music Programs: denotes programs where every kind of music regarded as a cultural riches with/without lyrics is performed, n) Broadcast Plan: denotes broadcast order to indicate the day, hours and time for the broadcasts, organized by the broadcaster in accordance to the Code and to this Regulation, st o) Annual Broadcast Period: denotes the period of time which starts from the 1 of January st 00:00 hours and ends in 31 of December 24:00 hours Turkey Mean Time of every year, p) Monthly Broadcast Period: denotes the period of time that starts from the first day of the month at 00:00 hours and ends at 24:00 Turkey Mean Time, r) Broadcast Day: denotes a period of 24 hours starting from 00:00 hours Turkey Mean Time, s) Broadcast time: denotes broadcasting hours and broadcasting of specific programs, t) Subtitles denote written information steady and/or in motion, mostly positioned at the bottom of the screen during the take or broadcast of the program. SECTION TWO Language of Broadcasts Language of Broadcasts Article 4 – The main language of broadcasts is Turkish. In the broadcasts, it must be ensured that Turkish is used as a language of communication without distorting its characteristics and rules and that Turkish is promoted as a modern language of culture, education and science. Exclusively no other broadcast can be done in language and dialects other than Turkish. But in the frame of this Regulation broadcasts can be made in the different languages and dialects traditionally used by Turkish citizens in their daily lives. Principals of broadcasts in the different languages and dialects traditionally used by Turkish citizens in their daily lives Article 5 – Broadcasts can also be made in the different languages and dialects traditionally used by Turkish citizens in their daily lives with the permission of the Supreme Board in accordance to the provisions of this Regulation. In these languages and dialects, broadcasts can be made for adults on news, music and culture. No broadcasts can be made towards the teaching of these languages and dialects. Radio and television institutions that own a public and private national broadcasting license can make broadcasts in these language and dialects, re-transmission broadcasts included; radio institutions shall not exceed 60 minutes per day and a total 5 hours per week, television institutions shall not exceed 45 minutes per day and a total of 4 hours per week. The broadcast of institutions that broadcast a television program in these language and dialects, including re-transmission broadcasts, shall be accompanied by Turkish subtitles or a translation in Turkish after the program, which will fully correspond to the broadcast in terms of timing and the content, as regards radio broadcasts, a Turkish translation will be broadcast after the program. Application Article 6 – Public and private radio and television institutions; a) The language(s) and/or dialect(s) and the types of programs to be broadcasted in these languages and dialects, their positioning in the daily broadcasts and monthly and annual broadcasting plans with the executive board decision b) Documents certifying that the members of the supervisory board to be established specifically for these broadcasts, the director in charge, the staff of the news department and news presenters satisfy the criteria specified in Law no. 3984 and related regulations c) The copy of the undertaking contract signed by the authority that represents the legal entity signed in presence of the notary public Shall apply to the Supreme Board. The supreme Board should be notified by the changes occurring after the application and its approval should be taken. SECTION THREE Assessment, Permission and Requirements Assessment and Permission Article 7 – The Supreme Board inspects the information and documents in the applications by the public and private broadcasting institutions that want to make broadcasts in the different languages and dialects traditionally used by Turkish citizens in their daily lives and give a broadcast permit to the institutions who have fulfilled the requirements according to this regulation. On considering daily, monthly and annually plans of broadcasting institutions broadcasting in Turkish, broadcasting of single musical work of art and inclusion of cinema films which do not show a consistency is evaluated beyond the scope of this permit. Recourse to judicial means is possible concerning the dismissal of application by the Supreme Board. Requirements Article 8 – Broadcasting institutions which received a permit in order to broadcast in another language than Turkish are responsible and cannot violate the supremacy of the law, the basic principles of the Constitution, basic rights and liberties, national security, general morality, the fundamental characteristics of the Republic as set out in the constitution, the indivisible integrity of the state with its country and people, Law no. 3984 and the principles and procedures set out in the regulations published based on this law, the requirements foreseen by the Supreme Board and its conditions of permit and guarantees and should be made within the framework of a public service approach. The broadcasting institutions are responsible of not showing symbols other than the studio arrangements, the existing logo, sound effects and introductory sound signs during the time of broadcasting in other language and dialects. If necessary only images and symbols designating the Republic of Turkey can be used. SECTION FOUR Penalties Penalties Article 9 – Broadcasts violating the principals in the Code, principals of broadcasting and requirements foreseen by the Supreme Board shall be punished within the provisions of Article 33 of Law no. 3984. Broadcasting institutions that broadcast in language and dialects other than Turkish without the permit of the Supreme Board will be subjected to, broadcasting without a permit sanction, the provision of Additional Article 2 of Law no. 3984. Recourse to judicial means is possible concerning the sanctions of the Supreme Board to the broadcasting institutions. SECTION FIVE Article 10 – On conditions which are not addressed in this regulation will be subjected to the regulations published based on the Law no. 3984 on the Establishment and Broadcasts of Radios and Televisions Article 11 – The regulation on the Broadcasting Languages of Radios and Televisions dated 18/12/2002 no 24967published in the Official Gazette is ceased to be effective. Provisional Article 1 – Till the viewer-listener profile of the different languages and dialects traditionally used by Turkish citizens in their daily lives is determined, only public and special national broadcasting institutions can broadcast in these languages and dialects. The Supreme Board will with the demands from the country find the viewer-listener profile via a neccessary research. SECTION SIX Entry into Force and Implementation Entry into Force Article 12 – This Regulation enters into force on the date of its publication. Implementation Article 13 – The provisions of this Regulation is implemented by the Radio and Television Supreme Board. Justificació Article 2 – La present regulació ha estat preparada a partir de l’article 4 de la Llei 3984 de l’establiment i les emissions de ràdio i televisió, esmenada per la Llei 4771, i a partir de les disposicions incloses a la Convenció Europea sobre Televisió Transfronterera. Definicions Article 3 – Dels termes emprats en aquesta regulació; a) Consell Suprem fa referència al Consell Suprem de Ràdio i Televisió, b) Llei fa referència a la Llei núm. 3984 de l’establiment i les emissions de ràdios i televisions, c) Mitjà de comunicació fa referència a tot tipus de mitjà que transmeti el senyal emès pel centre que realitzi programes de ràdio i televisió, d’una o més d’una emissió de ràdio o televisió o bé ambdues coses, tot utilitzant qualsevol tècnica, cap a una ràdio, receptors televisius i/o centres de distribució de dades, d) Canal temàtic fa referència al canal que emet únicament sobre un tema específic, com ara notícies, documentals, esports, música i tipus de programa relacionats, e) Emissió nacional fa referència a les emissions de ràdio, televisió o dades realitzades per a tot el país, f) Emissió regional fa referència a les emissions radiotelevisives fetes a almenys tres províncies colindants i a un mínim del setanta per cent de l’àrea de la regió geogràfica en qüestió, g) Emissió local fa referència a les emissions de ràdio, televisió i dades fetes tot tenint en compte la partició civil, per a una subprovíncia (inclosa la subprovíncia central) o almenys per al setanta per cent de l’àrea d’una província, h) Retransmissió fa referència a l’acció d’agafar tots o part dels serveis de programació radiotelevisiva sense introduir-hi cap canvi i transmetre els programes en temps real o en diferit, en funció de qüestions tècniques, perquè l’espectador els pugui mirar, siguin quins siguin els sistemes tècnics que les institucions emissores autoritzades utilitzin, i) Notícies fa referència als esdeveniments, qüestions i progressos actuals, socials, polítics, culturals i econòmics transmesos als espectadors o oients amb un punt de vista objectiu amb la finalitat de satisfer les necessitats del públic d’obtenció d’informació. j) Programes de notícies fa referència a la transmissió de programes de qüestions i esdeveniments detallats i avaluats, presentats als espectadors o als oients, tot excloent situacions extraordinàries, amb un horari d’emissió definit i normalment en un espai de temps determinat amb la finalitat de satisfer les necessitats del públic d’obtenció d’informació k) Butlletí de notícies fa referència al tipus de programa d’esdeveniments, qüestions i progressos actuals, socials, polítics, culturals i econòmics transmesos per les capçaleres de la premsa i de les emissions, supervisats i recopilats, d’acord amb els principis de veracitat i rapidesa, i presentats als espectadors i als oients en una franja horària determinada, tot excloent situacions extraordinàries, amb la finalitat de satisfer les necessitats del públic d’obtenció d’informació. l) Programes culturals fan referència als programes concebuts per preservar, millorar, difondre i enriquir les creences, el coneixement i les pràctiques subjectes al pensament i a la vida de l’espectador, que es transmeten de generació en generació, d’acord amb els principis de la política cultural nacional, m) Programes de música fa referència als programes en què es contempla tot tipus de música com un tresor cultural, tant la música té lletra com si no, n) Pla d’emissió fa referència a l’ordre d’emissió que es dóna per indicar el dia, l’hora i la durada de les emissions, elaborat per l’emissora d’acord amb el Codi i amb aquesta Regulació, o) Període d’emissió anual fa referència al període de temps anual que va des de l’1 de gener a les 00:00 fins el 31 de desembre a les 24:00 de cada any, hora de Turquia, p) Període d’emissió mensual fa referència al període de temps que comença el primer dia de mes a les 00:00 i finalitza a les 24:00, hora de Turquia, r) Dia d’emissió fa referència al període de 24 hores que comença a les 00:00, hora de Turquia, s) Temps d’emissió fa referència a les hores d’emissió i a l’emissió de programes específics, t) Subtítols fa referència a la informació escrita immòbil i/o en moviment, normalment situada a la part inferior de la pantalla durant la gravació o emissió del programa. SECCIÓ IIª Llengua de les emissions Llengua de les emissions Article 4 – La llengua principal de les emissions és el turc. Cal garantir que en les emissions el turc sigui emprat com a llengua de comunicació sense deformar les seves característiques i normes, així com també que el turc sigui promogut com una llengua moderna de cultura, educació i ciència. No es pot emetre de manera exclusiva en cap altra llengua i dialecte que no sigui el turc. Però d’acord amb aquesta regulació es poden fer emissions en les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària. Principis de les emissions en les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària Article 5 – Les emissions també podran realitzar-se en les llengües i dialectes diferents emprats tradicionalment pels ciutadans turcs en la seva vida diària amb el consentiment del Consell Suprem d’acord amb les disposicions d’aquesta regulació. Les emissions en aquestes llengües i dialectes poden ser per a adults i poden contenir notícies, música i cultura. Les emissions no poden ser destinades a l’ensenyament d’aquestes llengües i dialectes. Les institucions radiotelevisives que disposen d’una llicència d’emissió nacional pública o privada podran emetre en aquestes llengües i dialectes, incloses les emissions de retransmissió; la durada de les emissions de ràdio no podrà sobrepassar els 60 minuts per dia i un total de 5 hores a la setmana, mentre que la durada de les emissions televisives no podrà sobrepassar els 45 minuts per dia i un total de 4 hores a la setmana. Les emissions de les institucions que emeten un programa televisiu en aquestes llengües o dialectes, incloses les emissions de retransmissió, aniran acompanyades de subtítols o la seva corresponent traducció en turc després del programa, que hauran de correspondre’s plenament amb la temporalització i el contingut de l’emissió. Pel que fa a les emissions radiofòniques, hauran d’anar seguides d’una traducció en llengua turca després del programa. Aplicació Article 6 – A les institucions de ràdio i televisió públiques o privades, el Consell Suprem aplicarà: a) la llengua o llengües i/o el dialecte o dialectes i els tipus de programes que s’emetin en aquestes llengües i dialectes, la seva col·locació a la graella d’emissions diàries i en els plans mensuals i anuals, d’acord amb la decisió del consell executiu, b) els documents que certifiquen que els membres del consell de supervisió (establert específicament per a aquestes emissions), el director responsable, el personal de la secció de notícies i els presentadors de les notícies satisfan els criteris establerts a la Llei núm. 3984 i a les regulacions relacionades, i c) la còpia del contracte de compromís signat per l’autoritat que representa a l’entitat legal en presència del notariat. Es notificaran els canvis introduïts posteriorment a l’aplicació al Consell Suprem, i aquests seran aprovats. SECCIÓ IIIª Avaluació, permisos i requisits Avaluació i permisos Article 7 – El Consell Suprem avaluarà la informació i els documents de les sol·licituds de les institucions emissores públiques o privades que vulguin emetre en les diverses llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària, i concedirà permisos d’emissió a les institucions que compleixin els requisits d’acord amb aquesta Regulació. A l’hora de prendre en consideració els plans d’emissió diaris, mensuals i anuals de les institucions emissores, tant l’emissió en turc, com l’emissió d’obres d’art estrictament musicals, com la inclusió de pel·lícules de cinema que no presentin una coherència seran avaluades de manera especial, més enllà dels criteris de concessió dels permisos. En cas que el Consell Suprem desestimi les sol·licituds es podrà recórrer a la via judicial. Requisits Article 8 – Les institucions emissores que han obtingut un permís d’emissió en una llengua diferent del turc assumeixen les seves responsabilitats i no podran infringir la supremacia de la llei, els principis bàsics de la Constitució, els drets i llibertats bàsics, la seguretat nacional, la moral general, les característiques fonamentals de la República establertes per la Constitució, la integritat indivisible de l’Estat amb el país i la seva gent, la Llei núm. 3984 i els principis i procediments establerts per les regulacions publicades d’acord amb aquesta llei i els requisits previstos pel Consell Suprem i les seves condicions amb relació als permisos i garanties; i les emissions s’han de dur a terme amb vocació de servei públic. Durant el temps d’emissió en altres llengües i dialectes, les institucions emissores seran responsables de no mostrar cap símbol que no sigui el material de l’estudi, el logotip existent, els efectes de so i les falques introductòries. En cas que sigui necessari, només es podran utilitzar imatges i símbols que facin referència a la República de Turquia. SECCIÓ IVª Sancions Sancions Article 9 – Les emissions que infringeixin els principis establerts en el Codi, els principis d’emissió i els requisits establerts pel Consell Suprem seran sancionades en virtut de les disposicions de l’article 33 de la Llei núm. 3984. Les institucions que emetin en llengües i dialectes diferents del turc sense el permís del Consell Suprem estaran subjectes a la disposició de l’article 2 addicional de la Llei núm. 3984, que fa referència a les sancions per les emissions sense llicència. Pel que fa a les sancions que el Consell Suprem imposi a les institucions emissores, es podrà recórrer a la via judicial. SECCIÓ Vª Article 10 – Les qüestions a les quals no es faci referència en aquesta Regulació estaran subjectes a les regulacions publicades en virtut de la Llei núm. 3984 de l’establiment i les emissions de ràdio i televisió. Article 11 – La Regulació núm. 24967 sobre les llengües de les emissions de ràdio i televisió, de 18 de desembre de 2002, publicada al Diari oficial, queda derogada. Article 1 provisional – Fins que no es determini el perfil dels espectadors-oients en llengües i dialectes emprats tradicionalment pels ciutadans turcs en la seva vida diària, només les institucions emissores nacionals públiques i especials podran emetre en aquestes llengües i dialectes. El Consell Suprem haurà de determinar el perfil del espectadors-oients a través de la demanda del país i mitjançant la recerca necessària. SECCIÓ VIª Entrada en vigor i aplicació Entrada en vigor Article 12 – Aquesta regulació entra en vigor el dia de la seva publicació. Aplicació Article 13 – Les disposicions d’aquesta regulació seran aplicades pel Consell Suprem de Ràdio i Televisió. [Versió oficial en finès / Official version in Finnish] LAKI LUKIOLAIN MUUTTAMISESTA N:o 766/ 2004 Annettu Helsingissä 13 päivänä elokuuta 2004 Eduskunnan päätöksen mukaisesti muutetaan 21 päivänä elokuuta 1998 annetun lukiolain (629/1998) 18 §, sellaisena kuin se on laissa 478/2002, ja lisätään lakiin uusi 18 a ja 18 b § seuraavasti: 4 luku Arviointi ja ylioppilastutkinto 18 § Ylioppilastutkinto Lukiokoulutuksen päätteeksi pannaan toimeen ylioppilastutkinto. Tutkinnon avulla selvitetään, ovatko opiskelijat omaksuneet lukion opetussuunnitelman mukaiset tiedot ja taidot sekä saavuttaneet lukiokoulutuksen tavoitteiden mukaisen riittävän kypsyyden. Tutkintoon sisältyy äidinkielessä ja kirjallisuudessa, toisessa kotimaisessa kielessä, vieraissa kielissä, matematiikassa ja reaaliaineissa järjestettäviä kokeita. Ylioppilastutkintoon kuuluu vähintään neljä koetta. Tutkintoon osallistuvan on suoritettava äidinkielessä ja kirjallisuudessa järjestettävä koe sekä valintansa mukaan kolme koetta ryhmästä, johon kuuluvat toisessa kotimaisessa kielessä, yhdessä vieraassa kielessä, matematiikassa ja reaaliaineissa järjestettävä koe. Näiden kokeiden lisäksi tutkintoon osallistuva voi suorittaa yhden tai useamman ylimääräisen kokeen. Valtioneuvoston asetuksella annetaan tarkempia säännöksiä osallistumisesta ylioppilastutkintoon, kokeista ja niiden uusimisesta, arvostelusta ja muusta tutkinnon toimeenpanosta. Ylioppilastutkinnon suorittaminen tuottaa yleisen jatko-opintokelpoisuuden korkeakouluihin. 18 a § Muun henkilön kuin lukion opiskelijan oikeus ylioppilastutkinnon suorittamiseen Muu henkilö kuin lukion oppimäärää suorittava opiskelija saa osallistua ylioppilastutkintoon ja siihen kuuluviin kokeisiin, jos hän on suorittanut: 1) lukion oppimäärän tai vastaavan ulkomaisen lukion oppimäärän; 2) vähintään kaksi ja puolivuotisen ammatillisen tutkinnon; 3) edellä 2 kohdassa tarkoitettua lyhyemmän, kuitenkin vähintään kaksivuotisen perusopetuksen tai sitä vastaavalle aikaisemmalle oppimäärälle perustuvan tutkinnon tai opinnot sekä jäljempänä 18 b §:ssä tarkoitetun lautakunnan määräämät lisäopinnot. Edellä 1 momentin 2 kohdassa mainittua tutkintoa suorittava opiskelija voi osallistua ylioppilastutkintoon ollessaan vielä opiskelijana asianomaiseen tutkintoon johtavassa koulutuksessa. Opiskelija voi osallistua tutkintoon aikaisintaan suoritettuaan puolentoista vuoden laajuiset opinnot. 18 b § Ylioppilastutkintolautakunta Opetusministeriö asettaa kolmeksi vuodeksi kerrallaan ylioppilastutkintolautakunnan, joka vastaa ylioppilastutkinnon johtamisesta, järjestämisestä ja toimeenpanosta. Valtioneuvoston asetuksella annetaan tarkempia säännöksiä lautakunnasta ja sen tehtävistä. Ylioppilastutkintolautakunta antaa määräyksiä kokeiden sisällöstä, koejärjestelyistä ja kokeiden arvostelusta. ---Tämä laki tulee voimaan 1 päivänä syyskuuta 2004. Tätä lakia sovelletaan ylioppilastutkintoon, joka suoritetaan loppuun aikaisintaan vuoden 2005 ensimmäisellä tutkintokerralla, siitä riippumatta, milloin tutkinnon suorittaminen on aloitettu. Ylioppilastutkintoon, joka suoritetaan loppuun vuoden 2004 toisella tutkintokerralla, sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä. Utvärdering och studentexamen 18 § Studentexamen Gymnasieutbildningen avslutas med en studentexamen. Med hjälp av studentexamen klarläggs om de studerande har tillägnat sig de kunskaper och färdigheter som anges i gymnasiets läroplan samt uppnått tillräcklig mognad enligt målen för gymnasieutbildningen. I examen ingår prov i modersmål och litteratur, det andra inhemska språket, främmande språk, matematik och realämnena. Studentexamen omfattar minst fyra prov. Examinanderna skall avlägga provet i modersmål och litteratur samt enligt eget val tre prov av en grupp som består av provet i det andra inhemska språket, provet i ett främmande språk, provet i matematik och provet i realämnena. Utöver dessa prov kan examinanderna delta i ett eller flera extra prov. Genom förordning av statsrådet utfärdas närmare bestämmelser om deltagande i studentexamen, prov och omtagning av dem, bedömning och genomförandet av examen i övrigt. Studentexamen ger allmän behörighet för fortsatta studier vid högskola. 18 a § Rätt för andra än gymnasiestuderande att avlägga studentexamen Andra än studerande som avlägger gymnasiets lärokurs får delta i studentexamen och studentexamensprov, om de har avlagt 1) gymnasiets lärokurs eller motsvarande lärokurs vid ett utländskt gymnasium, 2) en yrkesexamen som omfattar minst två och ett halvt år, 3) en examen eller studier som är kortare än den examen som avses i 2 punkten, förutsatt att examen eller studierna bygger på grundläggande utbildning i minst två år eller motsvarande tidigare lärokurs, samt de extra studier som föreskrivits av den nämnd som avses i 18 b §. En studerande som avlägger en examen som avses i 1 mom. 2 punkten kan delta i studentexamen medan han eller hon fortfarande deltar i den utbildning som leder till den examen som avses i 1 mom. 2 punkten. En studerande kan delta i examen tidigast efter att ha avlagt studier som omfattar ett och ett halvt år. 18 b § Studentexamensnämnden Undervisningsministeriet tillsätter för tre år i sänder en studentexamensnämnd med uppgift att leda, ordna och genomföra studentexamen. Närmare bestämmelser om nämnden och dess uppgifter utfärdas genom förordning av statsrådet. Studentexamensnämnden meddelar föreskrifter om provens innehåll samt om hur proven skall ordnas och bedömas. ---Denna lag träder i kraft den 1 september 2004. Lagen tillämpas på en studentexamen som slutförs tidigast vid det första examenstillfället 2005, oberoende av när det första provet i examen har avlagts. De bestämmelser som gäller när denna lag träder i kraft tillämpas på studentexamen som slutförs vid det andra examenstillfället 2004. Den studentexamensnämnd som är tillsatt för 2004–2006 fortsätter mandattiden ut. Matriculation examination Upper secondary education (gymnasieutbildningen) finishes with a matriculation examination. The purpose of the examination is to discover whether pupils have assimilated the knowledge and skills required by the curriculum for the upper secondary school and whether they have reached an adequate level of maturity in line with the goals of the upper secondary school. The examination consists of tests in the mother tongue and literature, in the second national language, in a foreign language, in mathematics and in general studies. The matriculation examination comprises at least four tests. The candidates must take a test in mother tongue and literature and, according to their choice, three tests out of a group consisting of the test in the second national language, the test in a foreign language, the test in mathematics and the test in general studies. In addition to these, the candidates may take one or several extra tests. Further regulations concerning the participation in the matriculation examination, the tests and their repetition, their marking and their realization in general shall be promulgated through a ministerial decree. The matriculation examination provides the general qualification to continue studies at university. 18 a. The right of other students to take the matriculation examination Students other than students having passed the upper secondary school curriculum may take the matriculation examination and its tests, provided that they have passed 1) the upper secondary school curriculum or an equivalent at a foreign upper secondary school, 2) a vocational studies qualification (yrkesexamen) comprising at least 2 ½ years of studies, 3) an examination or study which is shorter than the examination referred to in the two points above, provided that the examination or study is based on a basic education of at least 2 years or that it corresponds to the previous curriculum, as well as the extra courses that are stipulated by the committee mentioned in paragraph 18 b. st A student taking an examination mentioned in the 1 clause of paragraph 2 may take the matriculation examination while he or she is still in the process of completing the st education that leads to the examination mentioned in the 1 clause of paragraph 2. A student may take the examination at the earliest once he or she has completed a study of one and a half years. 18 b. The Matriculation Examination Committee (studentexamensnämnden) The Ministry of Education shall appoint for a period of 3 years a Matriculation Examination Committee with the task of conducting, arranging and carrying out the matriculation examination. Further regulations concerning the Committee and its tasks shall be promulgated through a ministerial decree. The Matriculation Examination Committee shall inform on the instructions concerning the content of the tests and how they shall be arranged and marked. ---- This act shall come into force on 1 September 2004. This act shall be applied to a matriculation examination which finishes at the earliest with the first session in 2005, regardless of when the first test of the examination has been carried out. These regulations, which shall be valid when this act comes into force, shall apply to the matriculation examination once the second session of 2004 is completed. The Matriculation Examination Committee appointed for the period 2004-2006 shall continue for the whole term of office. Examen d’accés a la universitat L’educació secundària superior (gymnasieutbildningen) es completa amb un examen d’accés a la universitat. La finalitat d’aquest examen és comprovar si els alumnes han assimilat els coneixements i habilitats exigits pel pla d’estudis de l’educació secundària superior i si han assolit un nivell satisfactori de maduresa en concordança amb els objectius de l’educació secundària superior. L’examen consta de proves de llengua materna i literatura, de la segona llengua nacional, d’una llengua estrangera, de matemàtiques i d’estudis generals. L’examen d’accés a la universitat comprèn almenys quatre proves. Els examinands han de fer obligatòriament una prova de llengua materna i literatura i tres proves més que poden ser triades a partir d’un conjunt de proves que comprenen la prova de la segona llengua nacional, la de llengua estrangera, la de matemàtiques i la d’estudis generals. A més d’aquestes, els examinands poden fer una o més proves addicionals. Es promulgaran altres regulacions mitjançant un decret ministerial per regular la participació a l’examen d’accés a la universitat, les proves i la seva repetició, la seva puntuació i la seva realització en general. L’examen d’accés a la universitat constitueix la qualificació general per continuar els estudis a la universitat. 18 a. El dret dels altres estudiants a fer l’examen d’accés a la universitat A més dels estudiants que hagin completat els estudis d’educació secundària superior, els altres estudiants també podran realitzar l’examen d’accés a la universitat i les proves que el configuren si han completat 1) els estudis d’educació secundària superior o un equivalent en un centre d’educació secundària superior estranger, 2) un títol d’estudis de formació professional (yrkesexamen) que comprengui almenys 2 anys i mig d’estudis, 3) un examen o uns estudis que siguin més curts que l’examen esmentat als dos punts anteriors, sempre i quan l’examen o els estudis consisteixin en una educació bàsica d’almenys 2 anys o que correspongui al pla d’estudis anterior, així com també els cursos addicionals estipulats pel comitè esmentat al paràgraf 18 b. Aquells estudiants que facin un dels exàmens esmentats a la 1ª clàusula del 2n paràgraf podran fer l’examen d’accés a la universitat quan encara es trobin en situació de completar l’educació que dugui a l’examen esmentat a la 1ª clàusula del 2n paràgraf. Els estudiants podran fer l’examen al més aviat un cop hagin completat uns estudis d’un any i mig. 18 b. El comitè de l’examen d’accés a la universitat (studentexamensnämnden) El Ministeri d’Educació nomenarà un comitè de l’examen d’accés a la universitat per a un període de 3 anys, que tindrà la tasca de dur a terme, arranjar i realitzar l’examen d’accés a la universitat. Mitjançant un decret ministerial es promulgaran altres regulacions que afectin el comitè i les seves tasques. El comitè de l’examen d’accés a la universitat informarà sobre les instruccions relacionades amb el contingut de les proves i la manera com s’hagin d’arranjar i puntuar. ---- Aquesta llei entrarà en vigor l’1 de setembre de 2004. Aquesta llei s’aplicarà a un examen d’accés a la universitat que finalitzi al més aviat amb la primera convocatòria, l’any 2005, independentment de quan s’hagi fet la primera prova de l’examen. Aquestes disposicions, que esdevindran vàlides quan aquesta llei entri en vigor, s’aplicaran a l’examen d’accés a la universitat un cop completada la segona convocatòria de 2004. The ethnic groups represented (in the first two maps, coloured in blue and red) are: Slovaks, Hungarians, the Roma, Ukrainians and Ruthenians (grouped together) and one last group containing others. The other two maps, coloured in grey, red and yellow, only show the location of the Hungarian minority, which is the biggest one in terms of numbers and of geographical presence. Although the maps are not sharp enough to appreciate the details, they allow to get a rough idea about where each group is located. In fact the same maps have also been published in the form of a poster by Lilium Aurum Könyvkiadó (www.liliumaurum.sk). The poster provides much more detailed information, including the proportion of each group in each district seat. L’Institut Fòrum (Forum Institute) ha incorporat al seu web (a la secció “Hungarians in Slovakia”) una sèrie de mapes ètnics d’Eslovàquia que mostren l’evolució de la població per etnicitat, del 1991 al 2001. Els grups ètnics representats (en els dos primers mapes, de color blau i vermell) són: els eslovacs, els hongaresos, els romà, els ucraïnesos i rutens (agrupats conjuntament) i un últim grup que aplega la resta. It was founded on the second day of December 1999, following the Good Friday Agreement. In order to create Foras na Gaeilge, the staff of Bord na Gaeilge, An Gúm (Publishers), and An Coiste Téarmaíochta (Terminology Committee) and their activities were all transferred to it. Its designated responsibilities entail facilitating and encouraging the speaking and writing of Irish in the public and private arena in the Republic of Ireland, and in Northern Ireland where there is appropriate demand, in the context of part three of the European Charter for Regional and Minority Languages. Moreover, Foras na Gaeilge has a role in advising administrations, North and South, as well as public bodies and other groups in the private and voluntary sectors in all matters relating to the Irish language. It also undertakes supportive projects and grant -aiding bodies and groups throughout the island of Ireland.
